Notice of EPA Region 3’s Intent to Terminate Pesticide Producing Establishment Registrations

SUMMARY: EPA Region 3 intends to terminate the pesticide producing establishment registrations identified below 45 days following the date this Notice is posted on the EPA Region 3 Web site for failure to file annual pesticide producing reports as required by section 7 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).

EFFECTIVE DATE: The list of pesticide producing establishments identified in this Notice will have their establishment registrations terminated on January 17, 2010.

BACKGROUND ON REGION 3'S USE OF WEB SITE TO PROVIDE PUBLIC NOTICE OF ITS INTENT TO TERMINATE ESTABLISHMENT REGISTRATIONS

TERMINATION OF PESTICIDE PRODUCING ESTABLISHMENT REGISTRATIONS: EPA Region 3 did not receive annual pesticide production reports for the establishments identified below for the 2008 calendar year and/or previous reporting years. EPA Region 3 attempted to provide Notice of Intent to Terminate letters directly to the establishment registrants at their last addresses of record but such letters were retuned unopened, and additional reasonable attempts to locate such establishment registrants were unsuccessful. Therefore, EPA Region 3 intends to terminate, without further notice, the registrations of the establishments identified below on January17, 2010 pursuant to 40 CFR 167.20(f) for failing to submit the annual pesticide production reports for the 2008 calendar year and/or previous reporting years.

Following EPA Region 3 ’s termination of the pesticide producing establishment registrations, production of pesticides, active ingredients or devices at the establishments identified below will be prohibited and considered to be unlawful acts under Section 12 of FIFRA subject to possible civil and/or criminal penalties. This Notice will not preclude EPA from seeking other appropriate remedies necessary for compliance with FIFRA.
