On March 31, 2014, Penn Engineering and Manufacturing (PEM) was accepted into EPA’s One Cleanup Program which provides Pennsylvania facilities with corrective action obligations under the Resource Conservation and Recovery Act (RCRA) to complete federal corrective action and, concurrently, receive a liability release from Pennsylvania under Pennsylvania’s Land Recycling Program.
PEM conducted a preliminary site investigation in 2013, the results of which were provide to EPA and PADEP in a November 1, 2013 Preliminary Site Investigation Findings report. As part of the investigation, potential Areas of Concern (AOCs) were identified and soil sample samples were collected within the identified AOCs. Groundwater samples were also collected from an inactive production well. All samples collected were analyzed for volatile organic compounds (VOCs). Constituents of concern (COCs) detected in soils included 1,1,1-trichloroethane (1,1,1-TCA) and 1,1-dichloroethene (1,1-DCE). COCs detected in groundwater included 1,1,1-TCA, 1,1-DCE, 1,4-dioxane and vinyl chloride.
On July 2, 2014, PEM submitted to EPA and PADEP an Investigation Work Plan Technical Memorandum #1 for additional investigation and characterization activities. PEM is currently in the process of conducting an assessment of overburden soil and the underlying bedrock aquifer at the site to characterize and determine the extent of soil and groundwater contamination.
Penn Engineering is subject to EPA’s Corrective Action Program under the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act (“RCRA”) of 1976, and the Hazardous and Solid Waste Amendments (“HSWA”) of 1984, 42 U.S.C. §§ 6901 et seq. (Corrective Action Program). The Corrective Action Program is designed to ensure that certain facilities subject to RCRA have investigated and cleaned up any releases of hazardous waste and hazardous constituents that have occurred at their property.
Penn Engineering has owned and operated the Facility since 1950, when it purchased the 120-acre property which was farmland at that time. The developed portion of the property only utilizes 13 acres. From 1950 through 2000, the Facility operated as Penn Engineering and Manufacturing Corporation, changing its name to Penn Engineering in 2000.
Penn Engineering is an active manufacturer of self-cinching fasteners for a variety of industries, including electronics, computers, data/telecommunications, medical, automotive, marine, and aircraft. Manufacturing operations include machining operations, passivation of stainless steel, and heat treatment of parts.
On May 3, 2011, Michael Jr. Baker, Inc. (Baker) conducted an Environmental Indicator (EI) Inspection of the Penn Engineering facility located in Danboro, Plumstead Township, Bucks County, Pennsylvania (Facility or Site), on behalf of EPA. The findings of the EI Inspection are documented in a December 2011 EI Inspection Report for Penn Engineering prepared by Baker. Also presented in the EI Inspection Report is a summary of the information reviewed by Baker in preparation for the EI Inspection, including records maintained by the Pennsylvania Department of Environmental Protection (PADEP) and EPA.
