Status

• In August 2011, the facility's Hazardous Waste Management Permit for Corrective Action was modified to incorporate a final remedy detailed in a Statement of Basis developed by the Virginia Department of Environmental Quality (DEQ), which includes active remediation and institutional and engineering controls. The Statement of Basis and Permit modifications underwent a 60-day public comment period during which a public meeting was conducted. No comments were received during the comment period. The modified Permit became effective on August 9, 2011 and represents Remedy Selection and Remedy Construction Complete determinations in accordance with the Corrective Action process.
• The final remedy detailed in the Statement of Basis includes in-situ chemical oxidation for remediation of VOCs and SVOCs in soil and groundwater, groundwater pump and treat operations to maintain hydraulic control of groundwater until clean up targets are met, landfill cap maintenance, institutional and engineering controls, and progress reporting. The in-situ chemical oxidation component of the proposed final remedy is based on the results of a pilot test study performed in support of the facility's CMS (April 2010).

Background

• The Cook Composites and Polymers (CCP) facility in Chatham, Pittsylvania County, Virginia occupies approximately 101 acres of property in the Tight Squeeze Industrial Park. 
• The Banister River is located approximately 1,200 ft south of the CCP facility.  Unnamed tributaries to the Banister River run just south of the CCP processing site. 
• The CCP facility primarily produces unsaturated polyester resins for use in the manufacturing of fiberglass boats, bathroom fixtures, sinks, and related specialty composite products.
• CCP has been conducting environmental investigations and cleanup activities since 1981.
• On September 25, 2003, DEQ completed an evaluation of available information and issued a “YES” determination for the “Migration of Contaminated Groundwater Under Control” Environmental Indicator (EI) under the Government Performance and Results Act (GPRA). 
• On April 20, 2005, DEQ completed an evaluation of available information and issued a “YES” determination for the “Current Human Exposures Under Control” EI under the GPRA.
• In April 2010, a Corrective Measures Study evaluating cleanup methods and the results of a pilot test study was completed and subsequently approved by the DEQ in May 2010. 
• On August 9, 2011, the facility’s Permit was modified to incorporate a final remedy in accordance with the Corrective Action process.  The Permit modifications and Statement of Basis underwent a 60-day public comment period as part of the modification process.  The Permit modification represents Remedy Selection and Remedy Construction Complete determinations.
• CCP conducts semi-annual (April and October) Community Advisory Committee meetings to provide interested persons with environmental status updates in addition to general plant operation status updates including upgrades, repairs, modifications, and health and safety.

Contaminants and Risks

• The primary constituents of concern in soil are benzene, toluene, ethylbenzene, and xylenes (BTEX), acetone, methyl-ethyl keytone (MEK), and methyl-isobutyl keytone (MIBK).
• Primary constituents of concern in groundwater are BTEX, acetone, and manganese.
• The identified impacts from constituents of concern are confined to the central and south central portions of the facility property designated as Sample Area 3 (SA-3) and Sample Area 5 (SA-5).
• The area designated as Sample Area 1 (SA-1) and located on the western portion of the property is currently occupied by a concrete capped soil landfill. Groundwater associated with this area has been monitored since 1982. No unacceptable impacts to groundwater from this area have been identified.
• No impacts to air, surface water, or sediments were identified during the environmental investigations.

Instituional Controls Information

Institutional controls implemented as part of the final remedy at the Cook Composites facility are included in the facility’s Permit and include land use deed restrictions to be filed shortly with local municipalities.  The institutional controls will;

• notify prospective buyers of the property of the environmental conditions at the Facility and of VDEQ’s selected corrective measures as part of the remedy for the Facility under RCRA Corrective Action;
• prohibit use of the property for residential purposes (including single family homes, multiple family dwellings, schools, day care facilities, child care centers, apartment buildings, dormitories, other residential style facilities, hospitals, and in-patient health care facilities) within the surveyed footprint of SA-1, SA-3, SA-5, and SA-12;
• prohibit the use of groundwater beneath the property except for non-contact cooling water and purposes to support selected corrective measures;
• require inspection and maintenance of the concrete cap over SWMUs 3, 4, 10A, 12, and 23;
• require vapor barriers be utilized in or beneath new, totally enclosed structures designed for occupation within the foot print of SA-3 and SA-5, unless it’s demonstrated to VDEQ that it’s not necessary to protect human health;
• restrict subsurface soil excavation below four feet except in conformance with an appropriate soil management plan; and
• restrict activities that would interfere with or adversely impact the integrity of the remedy.
