Status

The United States Environmental Protection Agency (USEPA) and West Virginia Department of Environmental Protection (WVDEP) conducted an initial Resource Conservation and Recovery Act (RCRA) Corrective Action (CA) site visit and meeting at the Facility on October 27, 2009. As a result of that initial visit, USEPA and WVDEP decided that additional information and sampling at the Facility was required to determine whether the Environmental Indicators (EIs) have been meet or if corrective action was required at the Facility. Quality Carriers, Inc. (QCI), as successors to Chemical Leaman Tank Lines, decided to address their RCRA CA obligations through the use of the West Virginia Voluntary Remediation Program (VRP). On September 9, 2011, the WVDEP approved QCI’s application to participate in the VRP. A Voluntary Remediation Agreement was successfully negotiated and signed on February 27, 2012.  A Site Assessment/RCRA Facility Investigation Work Plan was approved on July 6, 2012.

Background

• The former Chemical Leaman facility is on the fall line of the flood plain for the Kanawha River.
• The total area of the property is approximately 142-acres with facility situated on an approximately 10-acres portion of developed/improved land; the remainder of the property is comprised of steep, heavily wooded hillsides.
• In 1963, Chemical Leaman Tank Lines, Inc. purchased the Institute facility from Union Carbide and constructed a tanker truck washing facility. In 1993, Quality Systems, Inc. (QSI) began operating the tank washing business. In 1998, Chemical Leaman Corporation and Montgomery Tank Lines, Inc. merged and operations at the facility continued under the names Quality Carriers, Inc. and Quality Systems, Inc. Under this structure, Quala Systems continued as the operating entity for the tank washing operations.
• Currently, the property is owned by Quality Carriers, Inc., which has no operations at the Institute site. Trucking operations are managed by an affiliate partner, under contract to QCI; and the tank washing operation is operated by the same affiliate partner, using another name, but under agreement with Quala Systems.
• A RCRA Post Closure Care Permit, EPA ID# WVR000001719, was issued to Chemical Leaman Tank Lines on June 30, 1999. CLTL did not submit a Part B Application for renewal and their RCRA Post Closure Care Permit expired on September 30, 2009.

Contaminants and Risks

• The facility had a drum burial area and a disposal pit area. 
• The drum burial area includes a drum excavation area (.10 acres) where approximately 500 drums of waste and impacted soil were excavated; a bioremediation area (0.56 acres) where an estimated 2,400 cubic yards (yd3) of impacted soil was placed into eight bio-cells constructed on-site for biological treatment; and, a treated soil stockpile (0.11 acres) where approximately 2,200 yd3 of soil that met Land Disposal Restrictions (LDRs) were deposited.  
• A disposal pit, located along the dirt access road to the upper area of the wastewater treatment plant, was discovered during a 1994 subsurface investigation.
• From August 2003 to October 2005, the Facility conducted an in-situ bioremediation of the groundwater in the buried drum excavation area.
• Historical investigations have concluded that constituents of potential concern at the Facility include 1,1-dicloroethene, benzene, chlorobenzene, trichloroethene, and vinyl chloride.
