NOTICE OF INTENT TO ISSUE AN ADMINISTRATIVE ORDER ON CONSENT UNDER SECTION 7003 OF THE RESOURCE CONSERVATION AND RECOVERY ACT AND THE HAZARDOUS WASTE AND SOLID WASTE AMENDMENTS OF 1984

            The U.S. Environmental Protection Agency (EPA) invites public comment on a proposed Administrative Order on Consent (AOC) entered into between EPA and Chevron U.S.A. Inc. (Chevron) to clean up releases at or from the former Chevron gasoline service station located at 5801 Riggs Road in Chillum, Prince George’s County, Maryland (Facility).  The AOC is issued pursuant to Section 7003 of the Resource Conservation and Recovery Act (RCRA) as amended by the Hazardous and Solid Waste Amendments of 1984 (HSWA). 

BACKGROUND:  On April 3, 2008, EPA issued its Final Decision and Response to Comments (FDRTC) outlining the final remedy for a gasoline release that occurred at or from the Facility. The release impacts the neighboring Riggs Park community located in Washington DC (DC). The final remedy includes 5 components: (1) Continued operation of the existing groundwater remediation system in Maryland; (2) Expansion of the existing system by installing angle recovery wells under Eastern Avenue in DC; (3) Installation of an independent groundwater remediation system below Eastern Avenue in Riggs Park; (4) Installation of an oxygen injection curtain above Nicholson Street in Riggs Park; and (5) Installation of individual vapor mitigation systems in homes above the plume where measured indoor air concentrations have exceeded EPA’s standards.

PROPOSED AOC:  EPA proposes to issue the AOC under Section 7003 of RCRA.  In entering into the AOC, the mutual objective of EPA and Chevron is to implement the final remedy in accordance with the contents and schedule stipulated in the FDRTC and all attachments and amendments thereto.

INFORMATION SESSION:  EPA has scheduled an informal Availability Session for September 4, 2008, beginning at 5:30 pm at the Jessica LaSalle Elementary School Auditorium.  During that time representatives from the Agency for Toxic Substances and Disease Registry (ATSDR) and EPA will be available to answer questions regarding the proposed AOC. There will be a presentation on the AOC immediately following the Availability Session during the regularly scheduled monthly Lamond-Riggs Community Meeting from 6:30-8:30 pm.

COMMENT PROCESS: Persons wishing to comment on EPA’s proposed AOC must submit comments to EPA within the 30-day comment period beginning August 25, 2008, and ending September 23, 2008.  All such comments must be submitted in writing via mail, fax, or email before September 23, 2008 to the EPA Project Manager, Andrew Fan, at U.S. Environmental Protection Agency, Mail Code 3LC20, 1650 Arch Street, Philadelphia, PA 19103,  Fax: 215-814-3113 or Email: fan.andrew@epa.gov. 

FINAL AOC: EPA will make a final decision on the proposed AOC after considering all written comments received during the comment period.  After the end of the public comment period, EPA shall either determine the proposed AOC should be made effective or determine that modifications to the AOC are necessary, in which case EPA shall notify Chevron.  If Chevron agrees to the modifications, the AOC shall become effective upon Chevron’s receipt of a true and correct copy of the fully executed modified AOC.
