Site Description

Exxon Mobil Port Mobil Terminal is a petroleum bulk storage and distribution facility which began operations in 1934 and continues today. The facility is located on the eastern shoreline of the Arthur Kill, Staten Island, City of New York, and is bounded to the north and the west by the Arthur Kill, to the south by Charleston (a residential area), and to the east by the Clay Pit Pond State Park Preserve.

The site was sold to Kinder Morgan Liquids Terminals, LLC (EPA ID # NYR000132779) in 2005. However, Exxon Mobil is still responsible for on-going remediation.

The residential area includes an elementary school located within a half mile of the facility to the southeast, and the north and northeast surrounding area are zoned industrial by the City of New York. The site encompasses approximately 203 acres, of which 120 acres are used for petroleum storage and transfer operations. The current storage capacity at the facility is approximately 125 million gallons (2.98 million barrels) with an annual throughput of approximately 1.4 billion gallons (33.3 million barrels).

The operations at the facility include 40 above-ground tanks for the storage of petroleum products on site. Each of the 40 tanks is approximately 30 to 60 feet in height and most are placed in three rows approximately 200 feet apart and extend along the southern boundary of the facility in an area known as the "Tank Farm".

Directly northwest of the Tank Farm and adjacent to the Arthur Kill Road are two RCRA regulated surface impoundments, also known as the Upper and Lower Holding Ponds. On September 30, 2005, EPA approved the closure of these surface impoundments upon the condition that soil and/or groundwater underneath the two impoundments be investigated and remediated (if warranted) at a later date as part of the corrective action process.

At the present time, the surface impoundments are being used for managing precipitation induced runoff only. Adjacent to the surface impoundments is the North Beach Recovery Area, which was remediated in the 1980s under the authority of the New York State Department of Environmental Conservation (NYSDEC) Spill Response Program with residual contamination left in place at that time.

At the western end of the facility, adjacent to the Arthur Kill, are numerous berths for the unloading and loading of maritime vessels which travel through the Arthur Kill. This area is referred to as the "Bulkhead Area" and runs from north to south along the western edge of the facility.

The facility also receives petroleum products from the Colonial Pipeline which runs from Texas to New Jersey. A secondary pipeline runs under the Arthur Kill Road to the facility and is generally above ground inside the facility.

Portions of the facility are within the 100 Year Floodplain. The Surface Impoundments are located above the floodplain as are the tanks and associated containment areas. In addition, the area surrounding the surface impoundments has been graded such that the top surface of the impoundments is above the surrounding ground level. RCRA toxicity-characteristic hazardous waste was stored in these surface impoundments in the past.

The Final RCRA Facility Assessment (RFA) Report issued in July 1993 identified 62 solid waste management units (SWMUs) and 1 area of concern (AOC) at the facility.

Waters within Arthur Kill are designated by New York State Department of Environmental Conservation (NYSDEC) as SD Class (saline surface water) with restricted use (mostly fishing). The nearest drinking water well is 10 miles away. For purposes of investigation and remediation, the facility was divided into three remedial areas; the Bulkhead area, the Tank Farm area, and the SI/North Beach Area.

Additionally, the facility maintains and operates an above ground piping network to transfer petroleum products throughout the operating portion of the site. Until 1993, the facility has provided barge emptying services, and resulting wastewater was stored in the surface impoundments.

Site Responsibility and Legal Instrument

The Resource Conservation and Recovery Act (RCRA) Program of EPA Region 2 has the responsibility to ensure corrective action at the facility. On October 2, 1995, EPA issued a 3013 Order to conduct a soil and groundwater investigation of the site and to assess the impact of contamination migrating into the Arthur Kill River. The Order also requires that Mobil demonstrate to EPA that it has correctly installed and is maintaining a groundwater monitoring system around the surface impoundments.

Permit Status

A Part B permit application was submitted on September 25, 1991. Shortly thereafter, Port Mobil Terminal claimed it did not handle any hazardous wastes in the surface impoundments. Sampling conducted by EPA in March and April 1993 confirmed the generation of hazardous waste in violation of RCRA regulations, which has triggered a lawsuit by the U.S. Department of Justice (on behalf of EPA) against the facility.

Port Mobil lost interim status in 1994. The lawsuit was settled with the payment of a penalty of $8,200,000 and an additional $2,000,000 in a Land Acquisition and Environmental Restoration Project, in early 2002. The two surface impoundments were closed in late 2001, and an acceptable Closure Certification Report was approved on September 30, 2005.

On September 10, 2009, EPA issued 3008(h) Administrative Order on Consent was issued to both Kinder Morgan Liquids Terminals and Exxon Mobil Corporation, current and former owner of the facility respectively. The 3008(h) corrective action Order supersedes the 3013 Investigative Order. The completion of the RCRA Facility Investigation was public noticed (PN#: NY-2009-01) in the Staten Island Advance newspaper and was posted on the EPA Region 2 Website May 6, 2009. No comments were received.

The 3008(h) has expanded and enhanced the implementation of RCRA corrective action at the facility. All remedial actions are being performed under EPA oversight, and follow EPA's guidance and requirements.

Potential Threats and Contaminants

A RCRA Facility Investigation (RFI) was completed in 1997 and the Interim Corrective Measures (ICM) started the same year. On June 18, 1998, the RFI Report was submitted. The results of the RFI revealed that soils and groundwater at the facility have been impacted by petroleum hydrocarbons and inorganic compounds in several hot spots. The sources of the impacts were gasoline, and fuel oil distillates.

The primary compounds of concern include benzene, total BTEX (benzene, toluene,ethylbenzene and xylenes), total PAHs (such as naphthalene), and lead. In addition, the RFI confirmed the presence of light non-aqueous phase liquid (LNAPL) near three existing wells (LC-1, LC-2, and RFI-9), and five Geoprobe points. The 1998 RFI Report concluded that these pockets of LNAPL posed an immediate threat to the Arthur Kill.

From June 1998 to the present, additional investigation(s) and remediation were conducted at the facility, and were reported to EPA in quarterly ICM/RFI progress reports. These activities consisted of facility-wide groundwater monitoring, source removals from 12 hot spots (Tank 41, Boiler House, RFI-8, RFI 9 and other areas) and LNAPL recovery operations (wells LC-1/LC-2, ICM-1, RFI-7, and MW-100).

In 2003, an investigation was conducted as a result of the explosion occurred at the facility on February 21, 2003 which has damaged the structure of the Ship Berth 1A, Barge Berth 2, South Beach Shoreline, and the Tank 48 aboveground piping. Another important investigation was conducted in 2005, previous to the transfer of the property to Kinder Morgan, which has found that the Lube Oil Tanks were severely impacted.

The original RCRA Facility Investigation Report (RFI) was revised in December 3, 2004 to include new data periodically reported in the Interim Corrective Measures (ICM) and RFI progress reports. Subsequently, the RFI Report was updated on May 8, 2006 and January 17, 2007.

Cleanup Approach and Progress

RCRA corrective action activities at Mobil constitute two programs: The Interim Corrective Measures (ICM) being implemented in the Bulkhead and Tank Farm areas, and a facility-wide Monitored Natural Attenuation Program. Both programs will be enhanced by the introduction of an In-Situ Chemical Oxidation (ICO) technology in the groundwater recovery operations. ICO is very efficient in reducing dissolved petroleum contaminants from the groundwater. The MNA consists of 42 groundwater on-site monitoring wells, including 25 monitoring wells, along with active source removals.

The Interim Corrective Measures (ICM) and RCRA Facility Investigation (RFI) progress reports are submitted to EPA on a quarterly basis. The last ICM/RFI progress report was submitted on November 12, 2009.  Since recovery system initiations, approximately 2,192 gallons of product have been pumped from recovery wells and more than 150 gallons of product have been removed from monitoring wells.

On May 11, 2009, Mobil submitted the Monitored Natural Attenuation (MNA) Program Year Nine Report. The MNA is required by the 3008(h) Order, and has the purpose of evaluating biodegradation and migration of dissolved-phase petroleum in groundwater at the site. After nine years of MNA, the calculation of natural attenuation rates for stable and attenuating plumes show that the majority of the site displays generally decreasing trends in total benzene and total BTEX concentrations.

However, there are still wells with fluctuating and sometimes increasing BTEX and/or MTBE concentrations (e.g., ICM-1, RFI-8, RFI-7, MW-100), which are being targeted for direct remedial action or source removal, and more frequent monitoring. The RFI/ICM Progress Quarterly Report submitted on November 12, 2009 reveals that there is a thickness of 0.01 feet of floating oil (LNAPL) in MW-118 and 0.01 ft in MW RFI-7.  MW-118 is placed in the area of the 2003 barge explosion.

So far, the RCRA corrective action at the facility seems to be effective. The Corrective Measure Study (CMS) report, which enhances the cleanup by a proposed In-situ Chemical Oxidation process, was tentatively approved on May 23, 2013. The CMS report was Public Noticed in the Staten Island Advance newspaper and on the EPA's website on August 20, 2013. The public meeting took place at CYO-MIV Community Center on Staten Island September 18, 2013. The public comment period ended on October 10, 2013. Only one person provided comments to EPA. These comments were submitted to EPA in a letter which has since been responded to by the Agency.

As required by Section XI of the Order, a proposed Corrective Measures Implementation (CMI) Work Plan is required within sixty (60) days of receipt of this letter. The CMI Work Plan shall include reasonable schedules for all phases of the project; final design, construction, operation, maintenance, and long-term monitoring. We anticipate that the CMI Work Plan will be submitted by the second quarter of 2014.
