The Pine Bend Sanitary Landfill (PBSL) site is located in Inver Grove Heights, Dakota County, Minnesota. PBSL, the largest open landfill in Minnesota, encompasses approximately 255 acres and is an operating, mixed-municipal solid waste facility. The site was first issued a permit to operate by the Minnesota Pollution Control Agency (MPCA) on September 7, 1971. An adjacent permitted disposal site, the Crosby American Properties (CAP) Landfill, has been closed since 1989 and is now managed by MPCA under the Closed Landfill Program. Pine Bend Landfill, Inc., a wholly owned subsidiary of Browning-Ferris Industries (BFI), is the owner and permittee.
The primary concern is the volatile organic compound (VOC) contamination in groundwater from leachate migrating from the site. Approximately 50 people live within a one-mile radius of the site. Several private wells were contaminated with VOCs. All affected residents were connected to the municipal water supply.
A municipal waste cover was placed over the forty-acre cell (contamination source) in accordance with closure requirements, stated in the solid waste permit. A new solid waste permit was issued to the facility to continue operations. The new permit addresses the groundwater contamination.
Site ResponsibilityThis site is being addressed through federal, state, and potentially responsible party (PRP) actions.
Threats and ContaminantsThe primary concern is the VOC contamination in groundwater from leachate migrating from the site.
In an April 1985 Response Order by Consent signed by the state and PBSL, the PRPs were required to investigate the nature and extent of contamination at the site.
In 1991, the EPA concurred on a groundwater only Record of Decision (ROD) for operable unit (OU)1. The ROD was a groundwater only remedy because the landfill was regulated under an existing MPCA solid waste operating permit. The selected remedy for OU1 was a permanent alternative water supply and consisted of the following components: the extension of the existing municipal water supply; the connection of impacted or potentially impacted premises to the municipal water supply; and the permanent sealing of the private water supply wells. In September 1992, Amdura Corp. entered into an agreement with the state to temporarily provide bottled water to eight residences and complete an alternate water supply. In the fall of 1994, the extension of the present municipal water supply system was completed; the residents potentially affected by site contamination were connected to the system.
In September 1995, the EPA concurred in a "No Further Action" ROD, which addressed OU2 groundwater contamination. The ROD determined that no further CERCLA action would be necessary at the Site based on the following: 1) the completion of the components of the 1991 ROD remedy; 2) the compliance with requirements stated in the existing solid waste operating permit which addresses groundwater contamination; and 3) the source control and groundwater contamination actions were completed under the state permit requirements. The solid waste permit is re-evaluated by the MPCA every five years.
A Resource Conservation Recovery Act (RCRA) Subtitle D cap has been placed over all 90 unlined acres of the facility. PBSL has an active gas collection system that is tied into a gas-to-energy conversion plant. The final permit was issued.
The site was deleted from the National Priorities List on June 23, 1998.
Five-year reviews were completed in 2000, 2005, and 2010 and found that the remedy remains protective of human health and the environment.
The fourth Five Year Review was signed in February 2015. The review determined that the remedy is protective of human health and the environment because it eliminates the principal threat posed by the Site by preventing direct contact with contaminated groundwater. The residences have ben connected to the extended municipal water supply system in the affected groundwater area. The state solid waste permit is the vehicle through which the source control and groundwater contamination are being addressed, and the institutional controls have been implemented, maintained, and are effective.
