Compliance and Enforcement

Region 9 pursues enforcement against the owners and operators of public water systems who violate the drinking water requirements of the Safe Drinking Water Act.

Data to supagesrt regional enforcement efforts are based on violation reports from the national drinking water system, known as SDWIS, and from information provided to us by state/tribal agencies and our field inspectors.

Violations are prioritized based on risk to public health and consider the duration and level of exposure to a contaminant if a drinking water standard is exceeded. While the majority of drinking water enforcement in Region 9 is conducted by state/tribal agencies, EPA takes enforcement actions to share the workload with states and in cases where EPA is the sole legal authority to enforce a specific requirement. Enforcement on tribal lands is conducted by EPA, as states do not have this authority over the tribes.

The enforcement tools available to us include administrative orders, civil suits and criminal proceedings. Our choice is based on the seriousness of the violations and other factors.
