Beede Waste Oil Superfund Site

In the summer of 2001, EPA offered an early de minimis settlement opportunity to the lowest volume Beede potentially responsible parties ("PRPs"), which resulted in a settlement of Superfund liability for 496 Beede PRPs. Since that time, other PRPs have expressed interest in participating in a similar settlement opportunity. Consistent with EPA's goal to provide many of the de minimis Beede PRPs with an early opportunity to resolve their Superfund liability with EPA, the December 2001 Beede Site Newsletter stated that EPA was seriously considering offering another de minimis settlement opportunity to Beede PRPs in the winter or spring of 2002.

At this time, EPA plans to provide a 2nd settlement opportunity to an additional low volume tier of the remaining de minimis PRPs this spring. The exact size of the group and timing of the offer is dependent upon completion of ongoing tasks, such as decisions on PRP requests for waste quantity review submitted in 2001, and straight forward corrections to information impacting PRP status and volumetric ranking. We are also completing review of ability to pay claims submitted by several parties who received the first de minimis settlement offer.

All resulting changes in volume or party identity will be communicated to affected parties, and will be reflected in an updated volumetric ranking list planned for issuance shortly before the 2nd de minimis settlement offer is made to PRPs.
