Procedures for Requesting Voluntary Testimony of an EPA Employee or for the Production of Documents in Civil Legal Proceedings Where the United States is not a Party
If you are interested in obtaining testimony from an EPA employee
where EPA is not a party to the litigation then, pursuant to the
regulations found at 40
C.F.R. Part 2, Subpart C,
the following steps should be taken:
1(a) If the requestor is a private party, send a written request for the testimony, addressed to the attention of Mary J. Wilkes, Regional Counsel and Director, Office of Environmental Accountability, at the address listed below.
1(b) If the requestor is a federal, state or local agency, the requestor should address the written request to Gwendolyn Keyes Fleming, Regional Administrator at the address listed below.
2. All written requests must include the following information:
(a) A description of what the expected testimony would entail; and
(b) The reason why such testimony would be in the best interests of the EPA.3. The requestor also should provide the time frame in which the testimony is needed.
If the request is for the production of a particular document, it will be treated as a Freedom of Information Act (FOIA) request. To further expedite the process, a request may be sent directly to Priscilla Johnson, FOIA Coordinator, Office of Environmental Accountability at the address listed below.
