The site is divided into three separate projects:
Plant 2 was originally separated from the rest of the site under a legal agreement between EPA and Mercury Marine because the company was farther along with its Plant 2 studies. Both believed it was important to finalize a cleanup plan as soon as possible for this source of contamination into Cedar Creek. EPA finalized a document in March 2008 called the "record of decision" that describes the cleanup plan selected for the Plant 2 portion of the site. This document details a soil contamination cleanup plan along with ground-water monitoring. A ground-water cleanup plan will be included in another record of decision at a later date. Mercury Marine is
currently working with the city on a contract to sell the property to Cedarburg. The cleanup can proceed and the
property can be redeveloped if the city buys it.
Cedar Creek will have a proposed cleanup plan later this year with a record of decision planned for early 2010.
Because Amcast has filed for bankruptcy twice since 2004, it will not finish its share of the creek sampling
required under its legal agreement with EPA. So, Mercury Marine has taken over and will complete the project.
Based on a new legal agreement between EPA and Mercury Marine, the company is investigating the creek.
The Amcast property investigation has come to a halt since Amcast filed for bankruptcy. EPA is committed to cleaning up Amcast and surrounding private properties, so the area is being considered as a separate Superfund site. It is currently on a list of "proposed" sites. When this project is ready to continue, it will follow investigation processes similar to those at Plant 2 and Cedar Creek.
EPA and Wisconsin Department of Natural Resources continue to oversee Cedar Creek and Plant 2 under the federal Superfund law.
