U. S. Department of Justice, on behalf of U. S. Environmental Protection Agency, Ohio EPA and Ohio River Valley Water Sanitation Commission, has invited public comments on proposed amendments to two 2004 consent decrees. The decrees settled legal claims that Hamilton County and Cincinnati violated the Clean Water Act and Ohio law regarding combined sewer overflows and sanitary sewer overflows. In a June 5 letter, the three agencies conditionally approved a $3.29 billion Wet Weather Improvement Program to control CSOs and SSOs in Hamilton County. The three agencies approved the WWIP on condition that the U.S. District Court for the Southern District of Ohio would sign or “enter” the amendments to the two consent decrees.
The original documents are known as the CSO Consent Decree and the SSO Consent Decree. The proposed consent decree amendments were lodged with the District Court on July 28. A notice in the Aug. 3 Federal Register announced the public comment period. Comments should be submitted by Wednesday, Sept. 2, in accordance with directions on the U.S. Department of Justice Web site.
The three agencies and the Justice Department will review comments received during the public comment period in determining whether to ask the District Court to enter the consent decree amendments.
