FOIA Appeals Process
Requestors have the right to appeal the agency's decision to withhold all or portions of records for the following reasons: (1) when the Agency indicates there are no records responsive; (2) when a fee waiver is denied; and, (3) when a request for expedited processing is denied. A written appeal must be mailed no later than 30 calendar days after the date of the Agency's initial denial. An appeal to a fee waiver denial should be sent immediately to the Agency's FOIA Officer.
An appeal must reference the Request Identification Number (RIN), the
date of the initial denial determination, the name and address of the
person who issued the denial. The appeal should also identify the records
to which access was denied. If you feel your response has been denied
you may submit a written appeal to the U.S. EPA, Office of Environmental Information,
Records, Privacy, and FOIA Branch (2822T), 1200 Pennsylvania Avenue, N.W., Washington, D.C. 20460.
