What would be the consequences if EPA did not approve the DFW 8-hour SIP?

If EPA did not take an action on the SIP before us, then EPA could be legally challenged for not meeting its obligation under the Clean Air Act to review and either approve or disapprove a State’s SIP revision within 18 months of submittal.

If EPA proposed and ultimately finalized a disapproval of the DFW SIP, then our action would start a sanction clock as well as an obligation for a federal plan to be developed for the area. The sanction clock could only be turned off with our final approval of a new SIP submittal.

In lieu of the submittal of a revised moderate SIP for the DFW area, the Governor could request a voluntary, higher reclassification to either serious or severe nonattainment. Such an approach would not lead to cleaner air faster for the DFW area, especially if certain rules in the current plan were dropped by the State.
