What are our options if we approve the SIP and the area does not reach attainment by the June 15, 2010 attainment date?

If EPA approves the SIP, then all of the measures included in the State regulations become federally enforceable. If the area does not reach attainment by June 15, 2010, then the Clean Air Act does not penalize the area for not developing an acceptable plan, but EPA is required to reclassify the area to the next higher level, in this case to serious ozone nonattainment. EPA has six months after the attainment date of June 15, 2010 to make the determination whether the area has attained or must be reclassified. If the area is reclassified, then a new serious area SIP is required. We would expect, based on EPA actions with reclassifying marginal areas, that a new SIP would be required before the beginning of the 2012 ozone season.
