Proposed Permit Released for Public Comment - Doe Run Co., Viburnum, Missouri
INTRODUCTION
The U.S. Environmental Protection Agency (EPA) Region 7 and the Missouri Department of Natural Resources (MDNR) invite the public to attend a public availability session about the proposal to issue a Remedial Action Plan permit to Doe Run Co. in Viburnum, Missouri. See box below for details.
Also, EPA and MDNR invite the public to review the public record and provide comments on the proposed permit. The public comment period will start on June 14, 2006, and end on July 31, 2006. All written comments should be sent to the address below.
REMEDIAL ACTION PLAN PERMIT
The Remedial Action Plan permit, if issued, would allow Doe Run to:
- Transport and temporarily stage lead-contaminated soils removed from residential yards in the area
- Treat any soils that are deemed hazardous because they have the potential to leach lead
- Cap the Viburnum tailings pile with up to 100,000 tons of these soils.
Specifically, the soil would come from residential yards along the Viburnum Trend Lead Haul Roads Site, St. Joseph Minerals/City of Viburnum Site, Middlebrook Railhead Site (which is temporarily stored at Doe Run's Glover facility), and properties surrounding the Buick Smelter area. The permit would be issued under the authority of the Resource Conservation and Recovery Act.
EPA and MDNR believe that the proposed permit is beneficial to the community in a number of ways. First, it would use rich soil to cover portions of the tailings pile. The cover will prevent the wind from blowing lead-contaminated dust into the environment. Also, covering and vegetating the tailings pile will minimize the risk of release of potentially harmful lead-contaminated run-off and fugitive dust emissions from the fine-grained tailings to the environment. This will help protect streams and groundwater. The reuse of the soils as capping material also keeps those soils from taking up valuable space in landfills. The issuance of a Remedial Action Plan permit will require Doe Run to provide financial assurance in the form of a bond or another similar instrument for the long-term monitoring and maintenance of the cap and tailings pile. Finally, a Remedial Action Plan permit would allow greater regulatory oversight by EPA and MDNR.

EPA and MDNR are requesting public comment on the proposed permit. No decision has been made. EPA and MDNR will finalize the permit only after the public comment period ends and all comments are reviewed. EPA and MDNR encourage the public to review the Administrative Record to gain a better understanding of the activities and basis for EPA and MDNR's proposal to issue a permit.
