Mercury in the Air

The Clean Air Mercury Rule was vacated by the US Court of Appeals District of Columbia Circuit on February 8, 2008. The Court concluded that EPA's decision to delist Mercury emissions from power plants as a hazardous air pollutant is contrary to what Congress intended in the Clean Air Act

All six States within the Region submitted Mercury plans to EPA for review. Those plans are now on hold until such time as EPA decides what next steps to take in reconsidering its Mercury program.
