Regional Hearing Clerk Docket
Welcome to the Regional Hearing Clerk ("RHC") data base ("docket") for EPA Region 8. This site lists administrative actions and is the focal point for administrative proceedings under the Agency's Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties, Issuance of Compliance or Corrective Action Orders, and the Revocation, Termination or Suspension of Permits, ("The Consolidated Rules of Practice", "Rule(s)" or CROP") 40 C.F.R. Part 22. The Agency initiates enforcement actions when a person, industry, or other entity fails to comply with environmental laws and statutes.
Depending on the particular statute, actions taken against a respondent may include: 1) Notice of Violation; 2) Administrative Orders; 3) Complaints and Notice of Opportunity for Hearing; 4) Stop, Sale, or Use Order; and 5) Consent Agreements/Final Orders. These cases are given individual docket numbers by the RHC and are kept as the official Docket.
Enforcement documents filed with the Regional Hearing Clerks Office, located in the Office of Regional Counsel, are listed below alphabetically by respondent. A reverse chronological listing by date is also available. Currently the information on this web site includes all initial and final enforcement actions completed in Fiscal Year 2003. The fiscal year begins on October 1 and ends September 30. Regional Judicial Officers
Under the Consolidated Rules of Practice, the Regional Judicial Officer's Presiding Officer functions are bifurcated between the Administrative Procedure Act ("APA") and the non-APA provisions of the Rule. In proceedings subject to APA hearings, the Regional Judicial Officer serves as the Presiding Officer before an answer is filed in a proceeding. Non-APA proceedings are covered by Subpart I of the Consolidated Rules. Under Subpart I the Regional Judicial Officer serves as Presiding Officer throughout a proceeding.

Office of Administrative Law Judges
The EPA's Office of Administrative Law Judges (OALJ) is an independent office in the Office of the Administrator of the EPA. The Administrative Law Judges conduct hearings and render decisions in proceedings between the EPA and persons, businesses, government entities, and other organizations which are or are alleged to be regulated under environmental laws. Administrative Law Judges preside in enforcement and permit proceedings in accordance with the Administrative Procedure Act. Most enforcement actions initiated by the EPA are for the assessment of civil penalties.

Environmental Appeals Board
The Appeals Board is the final Agency decisionmaker on administrative appeals under all major environmental statutes that the Agency administers. It is an impartial four-member body that is independent of all Agency components outside the immediate Office of the Administrator. The Appeals Board sits in panels of three judges and makes decisions by majority vote.
