Section 404 (Clean Water Act) wetland violation sites
Abstract:
Wetlands are "areas that are soaked or flooded by surface or ground water frequently enough or for sufficient duration to support plants, birds, animals. and aquatic life. Wetlands generally include swamps, marshes, bogs, estuaries, and other inland and coastal areas, and are federally protected. Wetlands frequently serve as recharge/ discharge areas and are known as 'nature's kidneys' since they help purify water" (p. 70). The Clean Water Act (CWA) "is a 1977 amendment to the Federal Water Pollution Control Act of 1972, which set the basic structure for regulating discharges of pollutants to waters of the US" (EPA 1994, p. 73). "Section 404 of the nation's Clean Water Act is the primary regulation protecting wetlands. Section 404 regulates the discharge of dredged and fill materials into all waters of the US, including wetlands, and establishes a permit program to ensure that such discharges comply with requirements. The EPA and Army Corps of Engineers jointly administer the Section 404 program, and the US Fish and Wildlife Service and other state agencies have advisory roles" (EPA Fact Sheet)
