Stormwater Permits for Construction

Regional Information
EPA Region 8 is the permitting authority for construction activities located on Federal facilities in Colorado and Indian country in Colorado, Montana, North Dakota, South Dakota, Utah, and Wyoming.
To obtain permit coverage:
- A site-specific pollution prevention plan (SWPPP) must be complete prior to applying;
- Conditions applicable to the Flathead Indian Reservation and Fort Peck Indian Reservation must be met;
- An application must be submitted using EPA's Notice of Intent Processing Center (paper forms need prior approval); and
- After submitting a complete application online, there is a 14-day waiting period before the project can break ground.

Special conditions applicable to the Flathead Indian Reservation:
For activities on the Flathead Indian Reservation, you must:
1) Send the pollution prevention plan (SWPPP) to the Tribes at least 30 days before construction starts;
2) Before submitting a Notice of Termination (NOT), clearly demonstrate to an appointed tribal staff person during an on-site inspection that requriements for site stabilization have been met; and
3) Send a copy of the Notice of Intent (NOI) application and Notice of Termination (NOT) to the Tribes.

Special Conditions Applicable to Construction Activities within the Fort Peck Indian Reservation
For activities on the Fort Peck Indian Reservation, you must notify the Fort Peck Office of Environmental Protection two weeks prior to commencing construction.
