Land Disposal Units and Loss of Interim Status When EPA promulgated the initial RCRA hazardous waste regulations in 1980, certain existing land disposal facilities (LDFs) (e.g., facilities with landfills, surface impoundments, and waste piles) were managing wastes which became hazardous waste under the new regulations. These facilities were allowed under RCRA to continue to manage those wastes prior to obtaining a full RCRA permit if they obtained "interim status." When a facility obtains interim status, the owner or operator must notify EPA of the types and amounts of waste they will be handling and what waste management activities they will be conducting, and submit a part A permit application providing basic facility information (Section 270.70(a)). As EPA expanded the scope of RCRA by promulgating new hazardous waste listings and characteristics, facilities previously not subject to RCRA become subject and are required to obtain interim status. When do these LDFs lose interim status and become subject to the requirements to obtain a full permit for compliance with the standards for permitted hazardous waste facilities? When LDFs lose interim status varies depending upon when the unit obtained interim status. LDFs which obtained interim status prior to November 8, 1984, lost interim status on November 8, 1985, unless the owner or operator submitted a part B application for a permit prior to November 8, 1985, and the owner/operator certified compliance with all applicable groundwater monitoring and financial responsibility requirements (Section 270.73(c)). (In contrast to the part A application's basic facility information, the part B application provides EPA the details necessary to draft the facility's operating permit.) LDFs that obtain interim status after November 8, 1984, lose interim status twelve months after the effective date of the statutory or regulatory change which subjects them to permitting requirements, again unless the owner or operator submits a part B application prior to the twelve-month deadline, and the owner/operator certifies compliance with all applicable groundwater monitoring and financial responsibility requirements (Section 270.73(d)). LDFs that have obtained interim status may make changes at the facility (for example, to manage hazardous wastes they did not previously identify in their Part A application) (Sections 270.72(a)(1)-(3). LDFs that have been granted authority to operate under these provisions similarly will lose their interim status twelve months from the effective date of the requirement, unless the owner or operator certifies that the unit is in compliance with all applicable groundwater monitoring and financial responsibility requirements (Section 270.73(e)). 2. Universal Waste Transfer Facility Storage Time Limit The universal waste management standards of 40 CFR Part 273, Subpart D, outline the streamlined provisions for transporters of hazardous waste batteries, pesticides, and thermostats classified as universal waste. During the normal course of transportation, transporters of universal waste are allowed to temporarily hold waste shipments at transfer facilities for ten days (Section 273.53). Section 273.6 defines a transfer facility as any transportation-related facility such as a loading dock, parking area, or storage area where a transporter can store universal waste. If the transporter exceeds the ten-day storage time period at a transfer facility, with what additional regulations is the transporter required to comply? If a transporter stores universal waste at a transfer facility for more than ten days, the transporter would meet the definition of a universal waste handler, and would be required to comply with the universal waste handler regulations under Part 273, Subparts B and C (60 FR 25501; May 11, 1995). The definition of a universal waste handler includes facilities that receive universal waste from other handlers, provided they do not impermissibly treat, dispose, or recycle universal wastes. As a universal waste handler, the transporter may need to comply with additional notification, labeling/marking, employee training, and tracking requirements. The transporter normally would not be required to obtain a permit for storage, however, unless the transfer facility becomes a destination facility, as defined in Section 273.6. 3. Battery Management Activities in Containment Buildings On August 18, 1992 (57 FR 37194), EPA promulgated regulations in 40 CFR for the storage and treatment of hazardous waste in containment buildings. The regulations contain separate design and operating standards, depending on whether hazardous wastes managed in the containment building contain free liquids. Free liquids are defined as liquids which readily separate from the solid portion of a waste under ambient temperature and pressure (Section 260.10). If hazardous wastes containing free liquids are managed in a containment building, the owner or operator must install a secondary containment system with a liquid collection and removal system (Sections 264/265.1101(b)). Would management of hazardous waste batteries in a containment building require the owner or operator to provide the unit with a secondary containment system? The owner or operator would need to provide the containment building with a secondary containment system if the batteries contain free liquids or if they are treated with free liquids. The presence of free liquids can be determined by conducting the Paint Filter Test (SW-846 Method 9095), a visual examination, or other appropriate means (57 FR 37214; August 18, 1992). Therefore, an owner or operator managing hazardous waste batteries in a containment building may conduct a visual examination to prove that the batteries do not contain free liquids (e.g., they are intact, sealed, etc.). However, an owner or operator managing batteries in a containment building in a manner that will release free liquids, such as removal of electrolyte, will be required to provide the unit with a secondary containment system and a liquid collection and removal system. CERCLA 4. CERCLA Section 103(c) Lasting Provision In 1998, buried drums containing CERCLA hazardous substances are discovered at a non-RCRA facility. Does the CERCLA Section 103(c) requirement to notify EPA of non-regulated TSDFs apply in this scenario? Discovery triggers notification obligations under CERCLA Section 103(c). Section 103(c) of CERCLA provides that within 180 days after the enactment of CERCLA, any person who owns or operates, who at the time of disposal owned or operated, or who accepted hazardous substances for transport and selected a facility at which hazardous substances, as defined in CERCLA Section 101(14)(C) (i.e., RCRA wastes), have been stored, treated, or disposed must notify EPA of the existence of those facilities unless the facility was permitted or accorded interim status under RCRA. Persons who identify sites after June 9, 1981, are still required to notify EPA of the existence of those sites, as the Section 103(c) provisions are not limited to sites identified by the June 9, 1981, statutory deadline. EPCRA 5. Closed Facilities and Hazardous Chemical Inventory Reporting A facility storing hazardous chemicals on site permanently ceases operations in 1997 and notifies the State Emergency Response Commission (SERC). Since the facility will no longer be in operation on March 1, 1998, must the owner/operator of the closed facility submit a Tier I or Tier II hazardous chemical inventory report form for 1997 by that date? If the facility had on site at any one time during 1997 at least 10,000 lbs. of a hazardous chemical, or at least 500 lbs. or the threshold planning quantity (TPQ) of an extremely hazardous substance (EHS), whichever is lower, the owner/operator must complete and submit a Tier I or Tier II hazardous chemical inventory report form to the SERC, Local Emergency Planning Committee (LEPC), and the fire department by March 1, 1998 (40 CFR Sections 370.20(b)(2), 370.25(a)). FINAL RULES RCRA "Financial Assurance Mechanisms for Owners and Operators of Municipal Solid Waste Landfill Facilities" April 10, 1998 (63 FR 17706) EPA amended the financial assurance regulations under RCRA for owners and operators of municipal solid waste landfills (MSWLFs). This rule added two financial assurance mechanisms to those currently available: a financial test for use by private owners and operators, and a corporate guarantee that allows companies to guarantee the costs for another owner or operator. The regulation is effective on April 10, 1998. "New Mexico: Final Authorization and Incorporation by Reference of State Hazardous Waste Management Program" April 28, 1998 (63 FR 23221) EPA decided, subject to public review and comment, that New Mexico's hazardous waste management program revisions satisfy the requirements necessary to qualify for final authorization. Final approval will take effect July 13, 1998, unless adverse written comments are received. Comments on New Mexico's revisions must be received on or before May 28, 1998. "Oklahoma: Final Authorization and Incorporation by Reference of State Hazardous Waste Management Program" April 30, 1998 (63 FR 23673) EPA decided, subject to public review and comment, that Oklahoma's hazardous waste management program revisions satisfy the requirements necessary to qualify for final authorization. Final approval will be effective July 14, 1998 unless adverse comments are received. Comments must be received on or before June 1, 1998. CERCLA "National Priorities List, Notice of Partial Deletion; Celanese Corporation Shelby Fiber Operations Superfund Site" April 17, 1998 (63 FR 19192) EPA announced the deletion of portions of the Celanese Corporation Shelby Fiber Operations Superfund Site, located in North Carolina, from the National Priorities List. EPA published its intent to delete the portions of the site on February 9, 1998 (63 FR 6508). EPA and the State of North Carolina have determined that no further response action by responsible parties is appropriate for the portions of the site. "National Priorities List, Notice of Deletion; Coalinga Asbestos Mine Site" April 24, 1998 (63 FR 20322) EPA announced the deletion of the Coalinga Asbestos Mine Site, located in California, from the National Priorities List. EPA published its intent to delete the site on November 19, 1997 (62 FR 61715). EPA and the State of California have determined that no further response action by responsible parties is appropriate for the site. EPCRA "Deletion of Certain Chemicals; Toxic Chemical Release Reporting; Community Right-to-Know" April 22, 1998 (63 FR 19838) EPA announced the deletion of dimethyldichlorosilane, trimethylchlorosilane, methyltrichlorosilane, 2,6-dimethylphenol (DMP), and 2-bromo-2-nitropropane-1.3-diol (Bronopol) from the list of chemicals subject to reporting under Section 313 of EPCRA and Section 6607 of the Pollution Prevention Act (PPA). This action is the result of a January 12, 1998 court order and is effective immediately. Proposed Rules RCRA "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Proposed Exclusion" April 15, 1998 (63 FR 18354) EPA proposed to grant a petition submitted by Kokoku Steel Cord Corporation in Scottsburg, Indiana, to exclude certain solid wastes generated by its wastewater treatment plant from the lists of hazardous wastes. Comments must be received on or before June 1, 1998. "Hazardous Waste Management Program: Final Authorization and Incorporation by Reference of State Hazardous Waste Management Program for New Mexico" April 28, 1998 (63 FR 23256) EPA announced the proposal to incorporate by reference revisions to New Mexico's hazardous waste program. Comments on the proposal must be received on or before May 28, 1998. "Hazardous Waste Management Program: Final Authorization and Incorporation by Reference of State Hazardous Waste Management Program for Oklahoma" April 30, 1998 (63 FR 23710) EPA announced its proposal to incorporate by reference revisions to Oklahoma's hazardous waste program. Comments on the proposal must be received on or before June 1, 1998. The amendments include the adoption of a new industrial classification system, the addition of new data elements, the establishment of procedures for protecting confidential business information (CBI), and clarification of certain other items. The amendments address the submission of RMP information to EPA and not the means by which the public could access the information. NOTICES RCRA "Agency Information Collection Activities - Proposed Collection; Comment Request; Survey of the Inorganic Chemicals Industry" April 8, 1998 (63 FR 17170) EPA announced that it will submit the following Information Collection Request (ICR) to the Office of Management and Budget (OMB): Survey of the Inorganic Chemicals Industry. Comments must be submitted on or before June 8, 1998. "Extension of the Policy on Enforcement of RCRA Section 3004(j) Storage Prohibition at Facilities Generating Mixed Radioactive/Hazardous Waste" April 9, 1998 (63 FR 17414) EPA announced an interim extension of its policy (61 FR 18588; April 26, 1998) on the civil enforcement of the storage prohibition in Section 3004(j) of RCRA at facilities that generate mixed waste. This action extends the April 1996 policy until October 31, 1998, and becomes effective on April 21, 1998. "Agency Information Collection Activities: Submissions for OMB Review; Comment Request; Facility Ground-Water Monitoring Requirements" April 15, 1998 (63 FR 18402) EPA announced that the following ICR was forwarded to OMB for review and approval: Facility Ground-Water Monitoring Requirements. Comments on the ICR must be received on or before May 15, 1998. "Underground Injection Control Program; Hazardous Waste Land Disposal Restrictions" April 15, 1998 (63 FR 18406) EPA announced a notice of approval for a case-by-case extension of the effective date of land disposal restrictions (LDR) for the DuPont Sabine River Works Facility. The effective date was extended from April 8, 1998, to April 8, 2000. This extension became effective on April 7, 1998. "Removal of Direct Final Rule for XL Project at Osi Specialties, Inc., Sistersville, WV" April 22, 1998 (63 FR 19837) EPA removed amendments to RCRA added by the direct final rule "Project XL Site-Specific Rulemaking for Osi Specialties, Inc., Sistersville, West Virginia" (63 FR 11124; March 6, 1998). EPA received enough relevant adverse comments to the rule to withdraw it. The withdrawal is effective April 22, 1998.
