Criteria for Meeting the Small, Arid, and Remote Municipal Solid Waste Landfill Exclusion The municipal solid waste landfill (MSWLF) criteria at 40 CFR Part 258 provide an exemption from the design standards and groundwater monitoring requirements for landfills which are small and located in arid or remote areas (Section 258.1(f)(1)). In addition to meeting other criteria, a landfill must dispose of less than 20 tons of solid waste daily, based on an annual average, in order to take advantage of this exemption (Section 258.1(f)(1)). Does the quantity of waste "disposed of" include the amount accepted at the facility for recycling or incineration? No. When determining whether a landfill meets the criteria for the small, arid, or remote landfill exemption, it is the amount of solid waste that is actually placed on the land (e.g., buried), not the amount received, that counts toward the 20 tons per day average. The small, arid, or remote landfill criteria do not limit the amount of waste a facility may accept on site for recycling or incineration. Therefore, as long as a facility does not bury or place within the MSWLF 20 tons or more of waste daily, based on an annual average, they can accept more than 20 tons per day for recycling or incineration and still qualify for the exemption. 2. Universal Waste Handler Recordkeeping Requirements RCRA regulates handlers of universal waste differently based on the total amount of universal waste generated or accumulated at any one time. A large quantity handler of universal waste is defined in 40 CFR Section 273.6 as a handler that accumulates 5,000 kg or more of universal waste at their location at any time. In contrast, a small quantity handler of universal waste is a facility which accumulates less than 5,000 kg of universal waste at any one time. Are large or small quantity handlers of universal waste required to keep records tracking their universal waste shipments? Large quantity handlers of universal waste must track their universal waste shipments in accordance with the recordkeeping requirements under Section 273.39; small quantity handlers are not required to keep records of universal waste shipments (Section 273.19). The large quantity handler provisions require basic recordkeeping that tracks all universal waste shipments received and/or sent off-site from the facility. Records indicating receipt and/or shipment of universal waste must include the name and address of the originating facility or facility to which a universal waste was sent, the quantity of each type of universal waste received or sent, and the date of receipt or transport of universal waste. These records must be retained for a period of at least three years from the date the universal waste was either received or transported from the facility (Section 279.39(c)). The universal waste regulations do not require a specific recordkeeping form, but any standard business record such as a log, invoice, manifest, or bill of lading will generally be sufficient (Section 273.39(a), see also 60 FR 25530; May 11, 1995). Handlers should check with their state and/or implementing agency regarding potentially more stringent state regulations. 3. Containment Buildings Certification Forty CFR Parts 264 and 265, Subpart DD, contain standards for hazardous waste containment buildings. EPA promulgated standards for containment buildings in the August 18, 1992, Federal Register (57 FR 37194) to provide generators and treatment or storage facilities with a new management unit for bulky hazardous waste not amenable to accumulation, storage, or treatment in containers or tanks. Can a containment building be prefabricated by a manufacturer and used by another facility, or must the unit be built at the facility where it will be used? A containment building can be prefabricated and used by another facility. Owners and/or operators of containment buildings must comply with specific design and operating standards, yet they are not required to build the containment building at the facility where it will be used. However, the design standards require certification by a qualified registered professional engineer (Sections 264/265.1101(c)(2)). This certification states that the building has been designed in compliance with standards specified in Sections 264/265.1101. If the building is prefabricated off-site, the manufacturer or the owner and/or operator must obtain certification by a qualified registered professional engineer that the containment building meets design standards. The engineer's certification must be placed in the owner and/or operator's operating record, or kept with on-site files required for generators, who are not required to maintain operating records. UST 4. Federally Owned Underground Storage Tanks RCRA Subtitle I contains provisions applicable to owners and operators of underground storage tanks (UST) holding an accumulation of regulated substances, and requires EPA to develop regulations to implement these statutory provisions. On September 22, 1988, EPA promulgated the technical requirements that regulated USTs must meet at 40 CFR Part 280 (53 FR 37082). Federal facilities own and/or operate a number of UST systems throughout the United States. Are these federally owned or operated USTs subject to the UST requirements at 40 CFR Part 280? RCRA Section 9007 makes federally owned or operated USTs holding regulated substances subject to all federal, state, interstate, and local requirements applicable to such tanks including the Part 280 requirements. Section 280.10(a) applies the requirements of Part 280 to all owners and operators of tanks meeting the definition of underground storage tank in Section 280.12, except those specifically excluded. Section 280.12 defines owner as any person who owns an UST system in use on November 8, 1984, or brought into use after that date for storage, use, or dispensing of regulated substances. For UST systems in use before November 8, 1984, but no longer in use on that date, owner is defined as any person who owned such UST system immediately before the discontinuation of its use (Section 280.12). Alternatively, operator is defined as any person in control of, or having responsibility for, the daily operation of the UST system (Section 280.12). The applicability of the UST requirements to federally owned and/or operated USTs is based on the word "person" used to define both owner and operator. Person is defined to mean "an individual, trust, firm, joint stock company, Federal Agency, corporation, state, municipality, commission, political subdivision of a state, or any intrastate body. [Consistent with RCRA Section 9007,] `Person' also includes a consortium, a joint venture, a commercial entity, and the United States Government" (Section 280.12). Thus, any tank meeting the definition of UST in Section 280.12 that is owned or operated by the federal government is subject to the Part 280 requirements. Tanks owned or operated by federal government entities, however, whose debts and liabilities are the debts and liabilities of the United States, would not be subject to the financial responsibility requirements in Part 280, Subpart H (Section 280.90(c)). EPCRA 5. Alloys and EPCRA Sections 311/312 Mixtures Reporting The owner/operator of a facility subject to MSDS and hazardous chemical inventory reporting (40 CFR Sections 370.21 and 370.25) under EPCRA Sections 311 and 312 has two options for reporting hazardous chemicals in a mixture. She may provide the required information either on each hazardous chemical component in the mixture, or on the mixture as a whole (Section 370.28(a)). The term "mixture" is not specifically defined under Part 370. Are alloys considered mixtures for the purposes of Part 370? Yes. For the purposes of Part 370, EPA uses OSHA's regulatory definition of mixture: "any combination of two or more chemicals, if the combination is not, in whole or in part, the result of a chemical reaction" (29 CFR Section 1910.1200(c)). Alloys meet this definition and are therefore considered mixtures. Thus, owners/operators may report the hazardous chemicals in an alloy by component or for the alloy as a whole. Final Rules RCRA "Technical Correction to Heading of Federal Register Publication Announcing Final Authorization of Revisions to Arizona Hazardous Waste Program" May 4, 1998 (63 FR 24453) EPA announced a correction in the title of a March 7, 1997, Federal Register (62 FR 10464). The title mistakenly referred to Nevada instead of Arizona. The correction is effective on May 4, 1998. "Technical Amendments to District of Columbia; Final Approval of State Underground Storage Tank Program; Correction of Effective Date under Congressional Review Act (CRA)" May 4, 1998 (63 FR 24453) EPA announced a correction in the effective date of a rule published July 9, 1997, (62 FR 36698) announcing a final determination on the District of Columbia's application for program approval of its underground storage tank (UST) program. This final rule changes the effective date from August 8, 1997, to May 4, 1998, in order to be consistent with the Congressional Review Act (CRA). "Organobromine Production Wastes; Identification and Listing of Hazardous Waste; Land Disposal Restrictions; Listing of CERCLA Hazardous Substances, Reportable Quantities; Final Rule" May 4, 1998 (63 FR 24595) EPA added two new hazardous waste codes to its current list of hazardous wastes found in 40 CFR Part 261. The first, K140, is floor sweepings, off-specification product, and spent filter media from the production of 2,4,6-tribromophenol. The second, 2,4,6-tribromophenol, is being added to the Part 261, Appendix VIII, list of hazardous constituents, as well as to the list of commercial chemical products as U408. In addition, EPA is modifying the land disposal restrictions (LDR) treatment standards by adding these new wastes. The rule also added U408 and K140 to the list of CERCLA hazardous substances found in 40 CFR Section 302.4 and adjusted the reportable quantities (RQ) to 100 pounds. The rule is effective November 4, 1998. "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Recycled Used Oil Management Standards" May 6, 1998 (63 FR 24963) EPA clarified several used oil-releated issues, including used oil contaminated with polychlorinated biphenyls (PCBs), the requirements applicable to releases of used oil, mixtures of conditionally exempt small quantity generator (CESQG) wastes and used oil, and marketers' recordkeeping requirements. The rule is effective July 6, 1998, unless EPA is notified by May 20, 1998, that any person intends to submit relevant adverse comment and that comment is received on or before June 5, 1998. "Land Disposal Restrictions Phase IV: Final Rule Promulgating Treatment Standards for Metal Wastes and Mineral Processing Wastes; Mineral Processing Secondary Materials and Bevill Exclusion Issues; Treatment Standards for Hazardous Soils, and Exclusion of Recycled Wood Preserving Wastewaters; Final Rule" May 26, 1998 (63 FR 28555) EPA promulgated LDR standards for metal-bearing wastes, including toxicity characteristic metal wastes, and hazardous wastes from mineral processing. The rule also revises universal treatment standards for twelve metal constituents. In addition, the rule amends the LDR treatment standards for soil contaminated with hazardous waste. Finally, the rule excludes from the definition of solid waste certain shredded circuit boards in recycling operations, and certain materials reused in wood preserving operations. The final rule is effective August 24, 1998. CERCLA "National Priorities List, Notice of Deletion; Pomona Oaks Residential Well Site" May 7, 1998 (63 FR 25169) EPA announced the deletion of the Pomona Oaks Residential Well Site, located in New Jersey, from the National Priorities List (NPL). EPA published its intent to delete the site on July 15, 1996 (61 FR 36858). EPA and the State of New Jersey have determined that no further response action by responsible parties is appropriate for the site. "National Priorities List, Notice of Deletion; National Lead Industries/Terracorp/Golden Auto Parts Superfund Site" May 21, 1998 (63 FR 27855) EPA announced the deletion of the National Lead Industries/Terracorp/Golden Auto Parts Superfund Site, located in Minnesota, from the NPL. EPA published its intent to delete the site on April 3, 1998 (63 FR 16465). EPA and the State of Minnesota have determined that no further response action by responsible parties is appropriate for the site. "National Priorities List, Notice of Deletion; H & K Sales Superfund Site" May 21, 1998 (63 FR 27855) EPA announced the deletion of the H & K Sales Superfund Site, located in Michigan, from the NPL. EPA published its intent to delete the site on March 30, 1998 (63 FR 15125). "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Recycled Used Oil Management Standards" May 6, 1998 (63 FR 25006) EPA proposed to eliminate errors and clarify ambiguities in the used oil management standards. A parallel rule reflecting the ambiguities was published in the final rules section of this Federal Register. "Salt River Pima-Maricopa Indian Community; Tentative Approval of an Alternative Liner System Design and Use of Alternative Daily Cover Material for the Salt River Municipal Solid Waste Landfill" May 8, 1998 (63 FR 25476) EPA announced a tentative determination on the application of the Salt River Pima-Maricopa Indian Community for approval of an alternative liner system design and use of alternative daily cover material for the Salt River Municipal Solid Waste Landfill, as well as a public hearing and public comment period. "Opportunity to Comment on Documents Used by the Department of Energy to Certify the Rocky Flats Environmental Technology Site to Ship Transuranic Waste to WIPP, as Required in: Criteria for the Certification and Re-certification of the Waste Isolation Pilot Plan's Compliance with the Disposal Regulations: Certification Decision." May 11, 1998 (63 FR 27901) EPA announced the availability of, and solicited public comments on, the Department of Energy documents used to certify the Rocky Flats Environmental Technology Site (RFETS) to ship transuranic radioactive waste to the Waste Isolation Pilot Plant (WIPP). Comments must be received on or before June 22, 1998. "Underground Injection Control Program; Hazardous Waste Injection Restrictions; Petition for Exemption - Class I Hazardous Waste Injection; Great Lakes Chemical Corporation" May 22, 1998 (63 FR 28382) EPA announced that a site-specific exemption from LDR was granted to Great Lakes Chemical Corporation (GLCC), for two Class I injection wells located at El Dorado, Arkansas. The action is effective May 13, 1998. "Changes to May 8, 1998, Federal Register Notice Regarding Salt River Municipal Solid Waste Landfill Tentative Approval; Address Correction to Public Hearing Location; Date Changes to Public Hearing and Public Comment Period" May 27, 1998 (63 FR 29011) EPA corrected the public hearing location address, as well as the dates for the public comment period and public hearing, for the tentative approval of the Salt River Municipal Solid Waste Landfill. CERCLA "Notice of Publication of Guidelines for Ecological Risk Assessment" May 14, 1998 (63 FR 26846) EPA announced the publication of Guidelines for Ecological Risk Assessment. The guidelines expand upon and replace the February 1992 publication Framework for Ecological Risk Assessment and will help improve the quality of ecological risk assessments at EPA while increasing the consistency of assessments among the Agency's program offices and Regions. "Agency Information Collection Activities: Submission for OMB Review; Comment Request; Superfund Site Evaluation and Hazard Ranking System" May 22, 1998 (63 FR 28380) EPA announced that the following ICR has been submitted to OMB for review and approval: Superfund Site Evaluation and Hazard Ranking System. Comments on the ICR must be received on or before June 22, 1998. EPCRA "Public Meetings on the Toxic Release Inventory Reporting Form" May 26, 1998 (63 FR 28509) EPA will hold approximately nine meetings to solicit comments relating to the TRI reporting Form R. The purpose of the meetings is to obtain comments on ways to streamline reporting and ease access to available information. This notice announces two upcoming meetings in Atlanta, Georgia, and Kansas City, Missouri. Cross-Program "Final EPA Supplemental Environmental Projects Policy Issued" May 5, 1998 (63 FR 24796) EPA issued a revised, final EPA Supplemental Environmental Projects Policy that supersedes the May 1995 Interim Revised Supplemental Environmental Projects Policy. In the final policy, EPA refined and clarified the May 1995 policy based on experience gained in implementing the interim policy. The new policy will better assist EPA in exercising its enforcement discretion to establish appropriate settlement penalties and supplemental environmental projects (SEPs) that secure substantial improvements to public health and the environment. EPA will implement this policy effective May 1, 1998. "Contaminated Sediment Management Strategy" May 6, 1998 (63 FR 25037) EPA announced the availability of the Contaminated Sediment Management Strategy, an Agency workplan issued in support of EPA's regulatory and policy initiatives. The strategy does not propose new regulation and is Agency guidance only.
