Land Disposal Restrictions Treatment Standards for Hazardous Debris A facility can treat debris contaminated with hazardous waste to meet land disposal restrictions (LDR) by using the waste-specific treatment standards in 40 CFR Section 268.40 or by using the technologies in Section 268.45 (i.e., extraction, destruction, and immobilization). The Section 268.45 treatment standards for debris specify that the debris must be treated for each "contaminant subject to treatment" (Section 268.45(a)(1)). Are underlying hazardous constituents as defined in Section 268.2(i) considered "contaminants subject to treatment" for debris contaminated with characteristic hazardous waste? Underlying hazardous constituents are "contaminants subject to treatment" and must be identified and addressed under the debris standards for debris contaminated with characteristic hazardous waste. Therefore, if the debris contains underlying hazardous constituents at concentrations above those given in Section 268.48, the treatment method applied to the debris must effectively treat for those constituents. The underlying hazardous constituents must also be identified in a generator's LDR notification under Section 268.7 (see item 7 of the Generator Paperwork Requirements Table in Section 268.7(a)(4)). EPCRA 2. EPCRA Section 313: Water-Dissociable Nitrate Compounds Under EPCRA Section 313 (40 CFR Part 372), a covered facility is required to report all releases and waste management activities involving toxic chemicals for which the facility has exceeded an activity threshold. A covered facility otherwise uses 28,000 lbs. of water-dissociable nitrate compounds during a reporting year and must file a nitrate compounds Form R or Form A. During on-site waste treatment activities, filters capture all of the nitrate compounds from an aqueous wastestream. The filters are put through dryers to remove water from the filters, and then the filters are sent off-site for disposal at a landfill. How would the facility report the waste management activities associated with the nitrate compounds captured in the filter cake? Nitrate compounds are reportable under EPCRA Section 313 only when they are dissociated in water (40 CFR Section hmm..372.65). When the filters containing water-dissociable nitrate compounds are put through a dryer, the water in the filters usually evaporates, and the nitrate compounds, for the most part, are no longer dissociated in water. In the above situation, nitrate compounds are not actually being destroyed by the drying process of the filters, but the reportable form of the nitrate compound is being destroyed. Therefore, the quantity of nitrate compounds in the filters that are no longer dissociated in water must be reported as having been treated for destruction under Part II, Section 7A and 8.6. However, all of the water may not be removed from the filters during the drying process. If some water- dissociated nitrate compounds remain in the filters when the filters are sent off-site for disposal, the facility must report that amount of water-dissociated nitrate compounds in Part II, Section 6.2 and 8.1 of the nitrate compounds Form R. FINAL RULES RCRA "Alabama: Final Authorization of State Hazardous Waste Management Program Revisions" December 20, 2000 (65 FR 79769) Alabama has applied to EPA for final authorization of the changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on February 20, 2001, unless EPA receives adverse written comment by January 19, 2001. "Arizona: Final Authorization of State Hazardous Waste Management Program Revisions" December 22, 2000 (65 FR 80790) EPA withdrew the immediate final rule for Arizona, the Final Authorization of State Hazardous Waste Management Program Revisions published on October 27, 2000 (65 FR 79769), which approved revisions to Arizona's hazardous waste rules, because opposing comments were received. "Deferral of Phase IV Standards for PCB's as a Constituent Subject to Treatment in Soil" December 26, 2000 (65 FR 81373) EPA deferred the requirement for PCBs to be considered constituents subject to treatment when they are present in soils that exhibit the toxicity characteristic for metals because they need more time to restudy the issue of appropriate treatment standards. "Montana: Final Authorization of State Hazardous Waste Management Program Revision" December 26, 2000 (65 FR 81381) EPA reissued a final rule authorizing the changes to the Montana hazardous waste program because the immediate final rule (65 FR 26750) had been withdrawn due to the receipt of opposing comments. In this rule, EPA responded to each of the comments received. This authorization will be effective on December 26, 2000. CERCLA "National Priorities List for Uncontrolled Hazardous Waste Sites" December 1, 2000 (65 FR 75179) EPA added eight new sites to the NPL: seven to the General Superfund Section, and one to the federal facilities section of the NPL. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" December 8, 2000 (65 FR 76945) EPA announced the deletion of the Rosemount Research Center site from the NPL. PROPOSED RULES RCRA "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Proposed Exclusion" December 4, 2000 (65 FR 75637) EPA proposed to use the Delisting Risk Assessment Software (DRAS) in the evaluation of a delisting petition. This proposal provides background information on the mechanics of the DRAS, and the use of the DRAS in delisting decision-making. "Land Disposal Restrictions: Notice of Intent to Grant a Site-Specific Treatment Variance to Dupont Environmental Treatment-Chambers Works Wastewater Treatment Plant, Deepwater, New Jersey" December 4, 2000 (65 FR 75651) EPA proposed to grant a site-specific treatment variance from the LDR standards for wastewater treatment sludge generated at the Dupont Environmental Treatment (DET)- Chambers Works Wastewater Treatment Plant located in Deepwater, New Jersey. This variance will grant an alternate treatment standard of 5.0 mg/L TCLP for the arsenic in the wastewater treatment sludge generated at this facility. "Hazardous Waste Management System; Proposed Exclusion for Identification and Listing Hazardous Waste" December 5, 2000 (65 FR 75897) EPA proposed to grant a petition submitted by Heritage Environmental Services, LLC to delist treated electric arc furnace dust (EAFD) produced at Nucor Steel, Division of Nucor Corporation located in Crawfordsville, Indiana from the lists of hazardous wastes contained in Subpart D of Part 261. EPA has tentatively decided to grant the exclusion based on an evaluation of waste-specific information provided by Heritage. "Alabama; Final Authorization of State Hazardous Waste Management Program Revisions" December 20, 2000 (65 FR 79769) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of Alabama. EPA authorized the state's program revisions as an immediate final rule without prior proposal in the final rules section (65 FR 79769; December 20, 2000). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by January 19, 2001, the immediate final rule will become effective February 20, 2001. CERCLA "National Priorities List for Uncontrolled Hazardous Waste Sites, Proposed Rule No. 34" December 1, 2000 (65 FR 75215) EPA proposed to add thirteen new sites to the NPL: twelve to the General Superfund Section, and one to the federal facilities section of the NPL.
