State authorization information is posted at EPA's State Rule Authorization and Adoption Status Web site. This site features maps of the United States indicating the authorization status for major RCRA rules, including base authorization. This Web site is located at: http://www.epa.gov/epaoswer/hazwaste/state/authstat.htm What are EPA's Comprehensive Procurement Guidelines? Under the Comprehensive Procurement Guidelines (CPG), EPA designates products that are or can be made with recovered materials, and recommends practices for buying such products. Once a product is designated, procuring agencies are required to purchase it with the highest recovered material content possible. Who is required to comply with the Comprehensive Procurement Guidelines (CPG)? The requirement to purchase an EPA-designated product containing recovered materials applies to procuring agencies that spend more than $10,000 a year on that item. Procuring agencies are federal, state, and local agencies, and their contractors, that use appropriated federal funds. Which hazardous wastes are covered under the federal universal waste program in 40 CFR Part 273? The federal universal waste program currently includes four types of hazardous wastes: batteries, pesticides, mercury thermostats, and lamps. In addition, authorized states may include additional wastes in their state universal waste programs. The table of hazardous substances in 40 CFR Section 302.4 lists each hazardous substance with both a "statutory" and a "final" reportable quantity (RQ). Which of these values should be used in determining whether there has been a release subject to CERCLA Section 103 release notification requirements? The value listed in the final RQ column is the reportable quantity that triggers CERCLA Section 103 release notification. The statutory RQ column, which notes the origin of the hazardous substance and its original RQ, is for historical purposes only. Are there any fees associated with the submission of a Tier II form? There are no federal fees associated with the submission of a Tier II form. However, owners and operators of facilities subject to 40 CFR Part 370 are encouraged to check with their state agencies, as some states support state or local EPCRA programs through state-specific fees for Tier II submissions. CALL CENTER QUESTIONS AND ANSWERS RCRA 1. Land Disposal Restrictions and Use Constituting Disposal A facility generates an ignitable hazardous waste (D001) which is used to produce asphalt that will be applied to the land. Recyclable materials used in a manner constituting disposal must meet three criteria before they can be applied to the land: 1) the product must be produced for the general public's use; 2) the recyclable products must undergo a chemical reaction so as to become physically inseparable from the product; and 3) the product must meet the applicable land disposal restriction (LDR) treatment standards in 40 CFR Part 268, Subpart D (Section 266.20(b)). Does a facility measure compliance with the LDR standards prior to incorporation of the D001 waste into the product or do the treatment standards apply after the waste becomes a product? Compliance with the LDR treatment standards applies to the product that will be used in a manner constituting disposal, not to the waste before it becomes a manufactured product. Recyclable materials that are used in a manner constituting disposal are not subject to regulation "if such products meet the applicable treatment standards in Subpart D of Part 268 (or applicable prohibition levels in Section 268.32 or RCRA Section 3004(d) where no treatment standards have been established) for each recyclable material (i.e., hazardous waste) that they contain" [emphasis added] (Section 266.20(b)). In this example, the asphalt product must meet the LDR treatment standards that correspond to D001 waste, namely DEACT, and meet Section 268.48 standards for underlying hazardous constituents before the asphalt can be applied to the land (Section 268.40). EPCRA 2. Reporting Toxic Chemicals in Waste Under EPCRA Section 313 For the purposes of TRI reporting, a covered facility must report all releases and other waste management activities associated with each toxic chemical for which an activity threshold has been exceeded. A covered facility exceeded an activity threshold for a toxic chemical that is contained in a hazardous waste as defined by RCRA in 40 CFR Section 261.3 (e.g., toluene in F005). Is the toxic chemical considered to be in a waste for the purposes of TRI reporting? Although the term "waste" has not been specifically defined for the purposes of TRI reporting, at this time EPA cannot anticipate a situation where toxic chemicals contained in hazardous wastes as defined under RCRA would not themselves be considered "wastes." All non-exempt releases and other waste management activities of toxic chemicals in wastes (including RCRA hazardous wastes) must be reported in Part II of the Form R. NEW PUBLICATIONS How to order. Final Rules RCRA "Wyoming: Final Authorization of State Hazardous Waste Management Program Revision" August 6, 2001 (66 FR 40911) EPA is authorizing the changes to the Wyoming hazardous waste program under RCRA through this final rule. On February 25, 1999, EPA Region VIII published an immediate final rule authorizing changes to Wyoming's hazardous waste program (64 FR 09278). However, EPA withdrew this immediate final rule due to the receipt of comments and the passage of Wyoming Senate File 147. Thus, through this action, EPA is additionally responding to all of the public comments that were received. "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Final Exclusion" August 9, 2001 (66 FR 41796) EPA is granting a petition submitted by Tenneco Automotive to delist 1,800 cubic yards of excavated stabilized wastewater treatment sludge currently stored in containment cells at Tenneco's Paragould, Arkansas facility. This final rule responds to the petition submitted by Tenneco to delist F006 stabilized sludge on a "generator specific'' basis from the lists of hazardous waste. This final authorization will become effective on October 9, 2001 unless EPA receives adverse written comment by September 10, 2001. "Project XL Site-specific Rulemaking for Yolo County Landfill, Davis, Yolo County, California" August 13, 2001 (66 FR 42441) EPA is finalizing a site-specific rule proposed on May 9, 2001 to implement a project under the Project XL program for the Yolo County Landfill, Davis, Yolo County, California. Yolo County will implement this project to use certain bioreactor techniques at its municipal solid waste landfill (MSWLF), specifically the addition of bulk or non-containerized liquid wastes into the landfill to accelerate the biodegradation of landfill waste and decrease the time it takes for the waste to stabilize in the landfill. "Vermont: Final Authorization of State Hazardous Waste Management Program Revision" August 16, 2001 (66 FR 42962) Vermont has applied for final authorization of the changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on October 15, 2001 unless EPA receives adverse written comment by September 17, 2001. "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Final Exclusion" August 16, 2001 (66 FR 43054) EPA is granting a petition submitted by Eastman Chemical Corporation--Texas Operations to delist the dewatered wastewater treatment sludge generated at its Longview, Texas facility. Accordingly, this final rule excludes the petitioned waste from the requirements of hazardous waste regulations under RCRA when disposed of in Subtitle D landfills but imposes testing conditions to ensure that the future-generated wastes remain qualified for delisting. "South Carolina: Final Authorization of State Hazardous Waste Management Program Revision" August 21, 2001 (66 FR 43798) South Carolina has applied for final authorization of the changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on October 22, 2001 unless EPA receives adverse written comment by September 20, 2001. "Project XL Site-specific Rulemaking for Buncombe County Landfill, Alexander, Buncombe County, North Carolina" August 22, 2001 (66 FR 44061) EPA is finalizing a site-specific rule proposed on April 16, 2001, to implement a project under the Project XL program for the Buncombe County Solid Waste Management Facility, Alexander, Buncombe County, North Carolina. EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on November 20, 2001 unless EPA receives adverse written comment by September 21, 2001. "Florida: Final Authorization of State Hazardous Waste Management Program Revision" August 23, 2001 (66 FR 44307) Florida has applied for final authorization of the changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on October 22, 2001 unless EPA receives adverse written comment by September 24, 2001. PROPOSED RULES RCRA "Extension of Comment Period for the Proposed Modifications of the Hazardous Waste Manifest System" August 10, 2001 (66 FR 42193) In response to the Association of State and Territorial Solid Waste Management Officials (ASTSWMO), EPA is extending the comment period on its proposed modifications to the Uniform Hazardous Waste Manifest regulations from August 20, 2001 to October 4, 2001 (66 FR 28240; May 22, 2001). "Hazardous Waste Management Program: Final Authorization of State Hazardous Waste Management Program Revisions for State of New Mexico" August 10, 2001 (66 FR 42194) EPA is proposing to grant final authorization to the hazardous waste program revisions submitted by the State of New Mexico. EPA authorized the state's program revisions as an immediate final rule without prior proposal in the final rules section (66 FR 42140; August 10, 2001). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by September 10, 2001, the immediate final rule will become effective October 9, 2001. "Vermont: Final Authorization of State Hazardous Waste Management Program Revision" August 16, 2001 (66 FR 42975) EPA is proposing to grant final authorization to the hazardous waste program revisions submitted by the State of Vermont. EPA authorized the state's program revisions as an immediate final rule without prior proposal in the final rules section (66 FR 42962; August 16, 2001). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by September 17, 2001, the immediate final rule will become effective October 15, 2001. "NESHAP: Standards for Hazardous Air Pollutants for Hazardous Waste Combustors--Proposed Amendments; Extension of Comment Period" August 17, 2001 (66 FR 43142) In response to several commenters' request for more time to respond to issues, EPA is extending the comment period on its proposed amendments to NESHAP: Final Standards for Hazardous Air Pollutants Waste Combustors (66 FR 35126; July 3, 2001). The comment period for this NPRM is extended from the original closing date of August 17, 2001 to October 16, 2001. EPCRA "Report on the Corrosion of Certain Alloys; Community Right-to- Know Toxic Chemical Release Reporting" August 22, 2001 (66 FR 44107) EPA announced the availability of a document titled "Report on the Corrosion of Certain Alloys". The Alloy Report contains information on the corrosion of stainless steel, brass, and bronze alloys and the availability of chromium, nickel, and copper from these alloys. Chromium, nickel, and copper contained in stainless steel, brass, and bronze alloys are listed toxic chemicals under Section 313 of EPCRA, and therefore may be reportable pursuant to EPCRA Section 313 and Section 6607 of the Pollution Prevention Act of 1990 (PPA). EPA is requesting comments on the technical contents of this document and its conclusions. Depending upon the comments received, EPA may propose to delist chromium, nickel, and copper when contained in some or all physical forms of stainless steel, brass and bronze alloys from the EPCRA Section 313 list of toxic chemicals.
