LDR Notification for Listed and Characteristic Wastes A facility generates a listed waste, F037, that is also characteristic for benzene (D018). Because the land disposal restrictions (LDR) treatment standard for F037 in 40 CFR Section 268.40 directly addresses the characteristic property (benzene), the generator may meet the treatment standard for the F037 listing in lieu of the characteristic treatment standard (Section 268.9(b)). Must the generator report both codes (F037 and D018) on the LDR notification? The generator need only report the listed waste code, F037, on the notification form. When the listed waste treatment standard operates in lieu of the characteristic treatment standard, the listed waste code would be included on the notification form in lieu of the characteristic waste code (56 FR 3867; January 31, 1991). This "in lieu of" principle applies only to wastes whose LDR treatment standard directly addresses the treatment standard for the characteristic constituent. In this instance, the treatment standard for F037 requires treatment of benzene, the constituent that causes the waste to exhibit the D018 characteristic. Therefore, the listed treatment standard operates in lieu of the characteristic treatment standard. However, if the listed treatment standard does not directly address the constituent that makes the waste characteristic, the generator must list both waste codes on the notification form, and the waste must meet both treatment standards before it can be land disposed. The alert describes several recent tank failures and identifies standards and precautions that apply to aboveground liquid storage tanks. All of the tank failures described were built by either Carolyn Equipment Co. (Fairfield, OH), or Nationwide Tanks Inc. (Hamilton, OH). Both of these companies have since gone out of business (Carolyn Equipment in 1990 and Nationwide Tanks in 1995). Owners of tanks produced by these two manufacturers are advised to take extra precautions to guard against tank failure. FINAL RULES RCRA "Florida: Final Authorization of State Hazardous Waste Management Program Revision" January 2, 2001 (66 FR 22) EPA had granted Florida final authorization for the changes to its hazardous waste program under RCRA on September 18, 2000 (65 FR 56256). These revisions consisted of corrective action provisions. EPA received five written comments, but decided not to withdraw the immediate final rule. "Louisiana: Final Authorization of State Hazardous Waste Management Program Revisions" January 2, 2001 (66 FR 23) Louisiana has applied for final authorization of the changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on March 5, 2001, unless EPA receives adverse written comment by February 1, 2001. "Oklahoma: Final Authorization of State Hazardous Waste Management Program Revisions" January 2, 2001 (66 FR 28) Oklahoma has applied for final authorization of the changes to its hazardous waste programunder RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the state's changes through this immediate final action. This final authorization will become effective on March 5, 2001, unless EPA receives adverse written comment by February 1, 2001. "Florida: Final Authorization of State Hazardous Waste Management Program Revision" January 2, 2001 (66 FR 33) EPA had granted Florida final authorization for the changes to its hazardous waste program under RCRA on September 18, 2000 (65 FR 56256). This rule extended the comment period and effective date for the authorization of Florida for the CAMU rule. This final authorization will become effective on March 5, 2001 unless EPA receives adverse written comment by February 1, 2001. "Indiana: Final Authorization of State Hazardous Waste Management Program Revision" January 4, 2001 (66 FR 733) Indiana has applied for final authorization of the changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all the requirements needed to qualify for final authorization, and is authorizing the state's changes through this final action. This final authorization will be effective immediately. "Georgia: Final Authorization of State Hazardous Waste Management Program Revision: Delay of Effective Date" January 29, 2001 (66 FR 8090) This action temporarily delayed the effective date of the rule entitled "Georgia: Final Authorization of State Hazardous Waste Management Program Revision," published on November 28, 2000 (65 FR 70804). The effective date of the rule is delayed for 60 days, from January 29, 2001, to a new effective date of March 30, 2001. EPCRA "Lead and Lead Compounds; Lowering of Reporting Thresholds; Community Right-to-Know Toxic Chemical Release Reporting" January 17, 2001 (66 FR 4499) EPA lowered reporting thresholds for lead and lead compounds which are subject to reporting under EPCRA Section 313 and Section 6607 of the Pollution Prevention Act of 1990 (PPA). The reporting thresholds are being lowered to 100 pounds. The lower reporting thresholds apply to lead and all lead compounds except for lead contained in stainless steel, brass, and bronze alloys. EPA is taking these actions pursuant to its authority under EPCRA Section 313(f)(2) to revise reporting thresholds. Today's actions also include modifications to certain reporting exemptions and requirements for lead and lead compounds. This rule shall take effect on February 16, 2001; with the first reports at the lower thresholds due on or before July 1, 2002, for the 2001 calendar year. PROPOPSD RULES RCRA "Hazardous Waste Management Program: Final Authorization of State Hazardous Waste Management Program Revisions for State of Louisiana" January 2, 2001 (66 FR 85) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of Louisiana. EPA authorized the state's program revisions as an immediate final rule without prior proposal in the final rules section (66 FR 23; January 2, 2001). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by February 1, 2001, the immediate final rule will become effective March 5, 2001. "Hazardous Waste Management Program: Final Authorization of State Hazardous Waste Management Program Revisions for State of Oklahoma" January 2, 2001 (66 FR 86) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of Oklahoma. EPA authorized the state's program revisions as an immediate final rule without prior proposal in the final rules section (66 FR 28; January 2, 2001). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by February 1, 2001, the immediate final rule will become effective March 5, 2001. CERCLA "National Priorities List for Uncontrolled Hazardous Waste Sites, Proposed Rule No. 35" January 11, 2001 (66 FR 2380) EPA proposed to add five new sites to the NPL, all to the General Superfund Section of the NPL. NOTICES RCRA "Underground Injection Control Program; Hazardous Waste Injection Restrictions; Petition for Exemption-Class I Hazardous Waste Injection; MERISOL USA LLC" January 9, 2001 (66 FR 1668) EPA announced that they granted MERISOL USA LLC an exemption from the LDR for a Class I injection well located at Houston, Texas. The company demonstrated that there would be no migration of hazardous constituents from the injection zone for as long as the waste remains hazardous. "Underground Injection Control Program Hazardous Waste Injection Restrictions; Petition for Exemption-Class I Hazardous Waste Injection; E. I. du Pont de Nemours & Co., Inc." January 23, 2001 (66 FR 7489) EPA announced that they granted E. I. du Pont de Nemours & Co., Inc. exemptions from the LDR for 11 Class I injection wells located at Victoria, Texas. The company demonstrated that there would be no migration of hazardous constituents from the injection zone for as long as the waste remains hazardous. CERCLA "Draft Guidance for National Hazardous Waste Ombudsman and Regional Superfund Ombudsmen Program" January 3, 2001 (66 FR 365) EPA has developed and is requesting comment on the Draft Guidance for National Hazardous Waste Ombudsman and Regional Superfund Ombudsmen Program. The purpose of this draft guidance is to explain the role of the Ombudsmen, their scope of activity, and the guidelines under which they coordinate and carry out their responsibilities. EPA believes this draft guidance will improve the effectiveness of this program by giving the Ombudsmen and those who may contact them a clear and consistent set of operating policies and expectations. Comments must be received by March 5, 2001. EPCRA "Notice of Stakeholder Meeting: Community Right-to-Know Toxic Chemical Release Reporting" January 3, 2001 (66 FR 362) EPA held a stakeholder meeting to solicit input on the types of information that EPA can provide to help users better understand TRI data reported under EPCRA Section 313. The meeting took place in Washington, D.C. on January 29, 2001, at 9:00AM. "Agency Information Collection Activities; Proposed Collection; Comment Request; 2001 Emergency Planning and Community Right-to-Know Act (EPCRA) and Risk Management Program (RMP) Implementation Status Questionnaire For Tribal Emergency Response Commissions (TERCs) and Their Duly Appointed Local Emergency Planning Committee(s) (LEPCs)" January 3, 2001 (66 FR 1975) EPA is planning to submit the following proposed Information Collection Request (ICR) to the Office of Management and Budget (OMB): 2001 Emergency Planning and Community Right-to-Know Act (EPCRA) and Risk Management Program (RMP) Implementation Status Questionnaire for Tribal Emergency Response Commissions (TERCs) and Their Duly Appointed Local Emergency Planning Committee(s) (LEPCs), EPA ICR No. 2004.01. CAA "Accidental Release Prevention Requirements; Risk Management Programs Under the Clean Air Act Section 112(r)(7); Distribution of Off-Site Consequence Analysis Information; Development of Read-Only Information Technology System and Qualified Researcher System" January 17, 2001 (66 FR 4021) This rule describes draft plans and request comments on two systems for providing access to information about the potential off-site consequences of accidental chemical releases from industrial facilities. One system would provide the public with "read-only" access to the information in electronic database form. The other system would provide qualified researchers with access to the information in paper or electronic database form. Both systems are required by Section 112(r) of the Clean Air Act, as revised by the Chemical Safety Information, Site Security and Fuels Regulatory Relief Act (CSISSFRRA) of 1999.
