Although universal wastes are considered hazardous wastes under RCRA, universal wastes are not considered hazardous wastes under the DOT HAZMAT regulations since they do not require hazardous waste manifests when transported (40 CFR Section 273.52). Can conditionally exempt small quantity generators (CESQGs) managing universal wastes choose to comply with the requirements in Section 261.5 instead of the universal waste requirements in Part 273? CESQGs have the option of handling their universal wastes under Part 273 or the reduced requirements in Section 261.5 (Section 273.8). EPA believes that allowing CESQGs to choose the regulatory option that best meets their circumstances will aid in assuring the effective collection, management, and disposal of universal wastes (60 FR 25492, 25510; May 11, 1995). Are used oil transporters required to obtain EPA identification numbers per the Part 279 requirements? Used oil transporters must obtain an EPA identification (ID) number in order to transport used oil (Section 279.42(a)). Used oil transporters may obtain an EPA ID number by either submitting EPA Form 8700-12 or a letter to the appropriate implementing agency (Section 279.42(b)). Under what circumstances may a state requirement be considered a potential applicable or relevant and appropriate requirement (ARAR) for a federal remedial action under CERCLA? Any standard promulgated by a state that is identified in a timely manner and is more stringent than federal requirements may be applicable or relevant and appropriate (Section 300.400(g)(4)). How long does the lead agency have to prepare a community involvement plan (CIP) for CERCLA removal actions expected to extend beyond 120 days? The lead agency must prepare a formal CIP within 120 days from the initiation of on-site removal activities (Section 300.415(n)(3)(ii)). For purposes of the Spill Prevention, Control, and Countermeasures (SPCC) regulations, when must a facility owner or operator conduct training for oil handling personnel as required in Section 112.7(f)(1)? Facility owners or operators have discretion as to the timing of appropriate training for their oil handling personnel as long as the timing meets the requirements of good engineering practice (67 FR 47042, 47108; July 17, 2002). CALL CENTER QUESTIONS & ANSWERS EPCRA 1. Treatment for Destruction and Conversion of Metals EPCRA Section 313 (40 CFR Part 372) requires facilities that meet certain threshold requirements to report on the Form R releases and other waste management activities of toxic chemicals, including information about the treatment of the chemicals. A TRI-covered facility processes more than 25,000 pounds of copper compounds. During the processing activity, the copper compounds are converted to elemental copper. Must the facility report the amount of copper compounds converted to copper as "treated on site" in Section 8.6 of the Form R? Although on-site treatment in Section 8.6 refers to the destruction or conversion of the toxic chemical, only treatment as part of waste management is reported on the Form R. Furthermore, because metals and metal category compounds cannot be destroyed, and chemical conversions of metals and metal category compounds are not considered treatment for destruction, metals and metal category compounds generally cannot be reported as treated on site in Section 8.6 of the Form R. The destruction of a toxic chemical during a processing activity is not considered on-site treatment for the purposes of the Form R because it does not occur during a waste management activity. There are, however, two instances in which chemical conversions of metals and metal category compounds are not considered treatment for destruction for TRI reporting purposes. First, when elemental barium or a barium compound is converted to barium sulfate, the conversion constitutes treatment for destruction because barium sulfate is specifically excluded from the barium compounds category. Conversion of elemental barium or a barium compound to barium sulfate results in the reportable form of the toxic chemical being destroyed. Similarly, aluminum and zinc, which are only reportable in the form of fumes or dust, are considered treated for destruction if they are converted into non- reportable forms (i.e., forms other than fumes or dust). 2. Applicability of EPCRA Section 313 to Facility Construction Activities EPCRA Section 313 reporting requirements apply to facilities meeting the applicability criteria in 40 CFR Section 372.22. During a facility's construction and prior to the onset of operations, toxic chemicals are otherwise used to construct and install process equipment. After the facility is constructed and begins operations, it will employ more than 10 full-time employees and will operate in a TRI-covered Standard Industrial Classification (SIC) code. Must the facility apply toxic chemicals used during the construction and installation of process equipment towards the otherwise use threshold? The toxic chemicals need not be considered towards any activity threshold. Prior to initial facility construction and before an SIC code can be assigned, the EPCRA Section 313 reporting criteria in Section 372.22, including the activity threshold criterion, do not have to be considered. However, if chemical activity thresholds for any toxic chemicals used in the construction and installation of process equipment are exceeded elsewhere at the facility during the reporting year, all non- exempt releases and other waste management activities of those toxic chemicals occurring during the reporting year must be reported, including those non-exempt release and other waste management quantities associated with the construction and installation of process equipment. FINAL RULES RCRA "Virginia: Approval of Financial Assurance Regulations for the Commonwealth's Municipal Solid Waste Landfill Permitting Program" October 7, 2003 (68 FR 57824) Virginia applied for final approval of changes to its municipal solid waste landfill permitting program under RCRA Section 4005. EPA determined that these changes satisfy all requirements necessary for final approval and allowed Virginia to adopt the financial assurance regulations in 40 CFR Part 258, Subpart G, through this rule. The final approval becomes effective on December 8, 2003, unless EPA receives adverse comments by November 6, 2003. "Municipal Solid Waste Landfill Location Restrictions for Airport Safety" October 15, 2003 (68 FR 59333) EPA amended the location restrictions section in 40 CFR Part 258, Criteria for Municipal Solid Waste Landfills (MSWLFs), in order to add a note providing information about landfill citing requirements enacted in the Wendell H. Ford Aviation Investment and Reform Act for the 21st Century. This amendment does not change existing criteria under RCRA with respect to citing MSWLF units. This amendment is effective on October 15, 2003. "West Virginia: Final Authorization of State Hazardous Waste Management Program Revision" October 16, 2003 (68 FR 59542) West Virginia applied for final authorization of changes to its hazardous waste program. EPA determined that these changes satisfy all requirements needed to qualify for final authorization and is authorizing West Virginia's changes through this rule. The final authorization becomes effective on December 15, 2003, unless EPA receives adverse written comments by November 17, 2003. "Criteria for Classification of Solid Waste Disposal Facilities and Practices" October 24, 2003 (68 FR 60856) EPA corrected 40 CFR Section 257.5 by reinstating the definition of uppermost aquifer to read as follows: "Uppermost aquifer means the geologic formation nearest the natural ground surface that is an aquifer, as well as lower aquifers that are hydraulically interconnected with this aquifer within the facility's property boundary." PROPOSED RULES RCRA "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Proposed Exclusion" October 1, 2003 (68 FR 56603) EPA proposed to grant a petition submitted by OxyVinyls, LP to exclude a solid waste generated by its Houston, Texas, Deer Park VCM Plant from the lists of hazardous wastes. EPA used the Delisting Risk Assessment Software in evaluating the impact of the petitioned waste on human health and the environment. The proposed decision would exclude the petitioned waste from the requirements of hazardous waste regulation under RCRA. Comments must be received by November 17, 2003. "Virginia: Approval of Financial Assurance Regulations for the Commonwealth's Municipal Solid Waste Landfill Permitting Program" October 7, 2003 (68 FR 57855) EPA proposed to grant final approval to the MSWLF permitting program revisions submitted by the Commonwealth of Virginia. EPA approved these changes as a direct final rule without prior proposal in the final rule section (68 FR 57855, October 7, 2003). The direct final rule provides a detailed rationale for approval. Unless adverse comments are received by November 6, 2003, the direct final rule will become effective December 8, 2003. "West Virginia: Final Authorization of State Hazardous Waste Management Program Revision" October 16, 2003 (68 FR 59563) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of West Virginia. EPA authorized the state's changes as a direct final rule without prior proposal in the final rules section (68 FR 59542, October 7, 2003). The direct final rule provides a detailed rationale for authorization. Unless adverse comments are received by November 17, 2003, the direct final rule will become effective December 15, 2003. "Massachusetts: Proposed Final Authorization of State Hazardous Waste Management Program Revisions; Proposed State-Specific Modification to Federal Hazardous Waste Regulations; Proposed Extension of Site-Specific Regulations for New England Universities' Laboratories XL Project" October 21, 2003 (68 FR 60060) EPA proposed three distinct but related proposals regarding Massachusetts's hazardous waste program. First, the Agency proposed to grant final authorization to Massachusetts for revisions to its hazardous waste program under RCRA. Second, EPA proposed to modify the federal hazardous waste regulations to allow for state-specific recycling provisions, pursuant to a proposal for flexibility submitted by the Massachusetts Department of Environmental Protection under the program established by the Joint EPA/State Agreement to Pursue Regulatory Innovation between the EPA and the Environmental Council of States. Finally, EPA proposed to extend the expiration date of site-specific regulations previously adopted by the Agency under the eXcellence and Leadership (XL) program allowing alternative RCRA generator requirements to be followed for laboratories at certain universities in Massachusetts (and Vermont). Comments on the proposed rules must be received by November 20, 2003. "Revisions to the Definition of Solid Waste" October 28, 2003 (68 FR 61557) EPA proposed revisions to the definition of solid waste to identify certain recyclable hazardous secondary materials as not discarded, and thus not subject to regulation as wastes under Subtitle C of RCRA. The proposed rule would also establish specific regulatory criteria for determining whether or not hazardous secondary materials are recycled legitimately. Comments must be postmarked by January 26, 2004. CERCLA "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" October 7, 2003 (68 FR 57855) EPA announced its intent to delete the Selected Perimeter Area (68 FR 44259) and the Surface Deletion Area (68 FR 44265) of the Rocky Mountain Arsenal National Priorities List Site On-Post Operable Unit from the National Priorities List (NPL) on July 28, 2003. In response to a request, EPA extended both public comment periods until October 27, 2003. "Advisory Committee for Regulatory Negotiation Concerning All Appropriate Inquiry; Meeting" October 21, 2003 (68 FR 60054) EPA announced that a meeting of the Negotiated Rulemaking Committee on All Appropriate Inquiry is scheduled for November 12 through November 14, 2003, in Washington, DC. The meeting is for the purpose of negotiating the contents of a proposed regulation setting federal standards and practices for conducting all appropriate inquiry. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" October 30, 2003 (68 FR 61783) EPA announced its intent to delete the Poamoho Section of the Del Monte Corporation Superfund Site from the NPL and requested comment on this proposed action. Comments must be submitted by December 1, 2003. Comments must be received by December 4, 2003. "RCRA Burden Reduction Initiative; Notice of Data Availability" October 29, 2003 (68 FR 61662) EPA requested additional comments on ideas for reducing the recordkeeping and reporting burden imposed on the states, the public, and the regulated community under RCRA Subtitle C. These additional ideas were suggested by commenters or are outgrowths of the RCRA Burden Reduction Initiative Proposed Rule (67 FR 2518; January 22, 2002).
