May 16, 1989.
AGENCY: Environmental Protection Agency.
ACTION: Notice of deletion of a site from the National Priorities List.
The Environmental Protection Agency (EPA) announces the deletion of the Voortman Farm Site from the National Priorities List (NPL). The NPL is Appendix B to the National Oil and Hazardous Substances Pollution Contingency Plan (NCP), which EPA promulgated pursuant to section 105 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), as amended. EPA and the Commonwealth of Pennsylvania have determined that no further Fund-financed remedial action is appropriate at this site, and that actions taken to date are protective of public health, welfare, and the environment.

The EPA identifies sites that appear to present a significant risk to public health, welfare, or the environment and maintains the NPL as the list of those sites. Sites on the NPL may be the subject of Hazardous Substance Superfund (Fund) financed remedial actions. Any site deleted from the NPL remains eligible for Fund-financed remedial actions in the unlikely event that conditions at the site warrant such action. Section 300.66(c)(8) of the NCP does not affect responsible party liability or impede agency efforts to recover costs associated with response efforts.
The site EPA deletes from the NPL is 1. Voortman Farm, Upper Saucon Township, PA.
An explanantion of the criteria for deleting this site from the NPL was presented in section II of the March 24, 1989, Notice of Intent to Delete (53 FR 48662). A description of the site and how it meets the criteria for deletion was presented in section IV of that Notice. A notice was also placed in a local newspaper announcing the Intent to Delete.
The closing date for comments on the Notice of Intent to Delete was May 1, 1989. No comments were received.
