National Oil and Hazardous Substances Contingency Plan; National Priorities List Update

AGENCY: Environmental Protection Agency.
ACTION:  Notice of deletion of a site from the National Priorities List.

SUMMARY:

The Environmental Protection Agency (EPA) announces the deletion of the Reeser's Landfill Superfund site in Upper Macungie Township, Pennsylvania from the National Priorities List (NPL). The NPL is Appendix B of the National Oil and Hazardous Substances Pollution Contingency Plan (NCP), 40 CFR part 300, which EPA promulgated pursuant to section 105 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), as amended. EPA and the Commonwealth of Pennsylvania have determined that all appropriate Fund-financed responses under CERCLA have been implemented and that no cleanup is appropriate. Moreover, EPA and the State of Pennsylvania have determined that conditions at the site are protective of public health, welfare, and the environment.

May 31, 1990.

SUPPLEMENTARY INFORMATION:

The site to be deleted from the NPL is Reeser's Landfill Superfund Site, Upper Macungie Township, Lehigh County, Pennsylvania.

A notice of intent to delete for this site was published in the Friday, March 2, 1990 Federal Register, Vol. 55, No. 42 beginning on page 7507. A notification was also published in the Bethlehem Globe-Times, a local newspaper, on March 14, 1990. The closing date for comments on the Notice of Intent to Delete was April 16, 1990. EPA received no comments.

The EPA identifies sites which appear to present a significant risk to public health, welfare, or the environment and it maintains the NPL as the list of those sites. Sites on the NPL may be the subject of Hazardous Substance Superfund (Fund-) financed remedial actions. Pursuant to Section 300.425(e)(3) of the NCP, Fund-financed actions may be taken at the sites deleted from the NPL should future conditions warrant such actions.

Deletion of a site from the NPL does not affect responsible party liability or impede agency efforts to recover costs associated with response efforts.

2. The NPL part 300; Appendix B is ammended as follows:

Remove the following entry and move the other entries accordingly:

Reeser's Landfill, Upper MacungieTownship, Pennsylvania.

The NPL will reflect this deletion in the next final update.
