Non-RCRA and Voluntary Cleanup Programs (VCPs)

Several states have developed voluntary cleanup programs (VCPs) to address some hazardous waste sites. Some state programs allow RCRA and/or Superfund sites to be addressed by these programs; others will not. There is significant interest in learning more about VCPs and the Memorandums of Understanding (MOUs) that some EPA Regions and some states are entering into with regard to use of state programs at RCRA Sites. Virtually all states have their own cleanup programs, independent of RCRA authorities. For example, most states have their own remedial programs analogous to the federal Superfund and several have "voluntary" cleanup programs, which are often particularly designed for Brownfield sites. States have used many of these authorities to achieve effective cleanups and promote redevelopment at RCRA TSDs. EPA supports this approach. In particular, there has been interest in integrated state cleanup programs (which consolidate most or all state cleanup programs (VCPs)). State VCPs, for example, have proven effective in accelerating cleanups at a number of RCRA cleanups (among the first four RCRA brownfields pilots, three involved the use of state "voluntary" authorities).
