Forthesection112(c)(6)analysis,incaseswherearegulationforagivensourcecategoryhasbeenpromulgated,thepercentofemissionssubjecttothestandardhasbeencredited.Forexample,inthesourcecategorygasolinedistributionstageI,only10percentoftheemissionsarefrommajorsourcessubjecttothestandardandhavebeencountedtowardthe90percentgoal.Forsourcecategorieswithregulationsthathavenotyetbeenpromulgated,EPAwillsubjecteachsignificantareasourcecategoryto standardsasdirectedbysection112(c)(6).Whentheregulationsforeachofthosecategoriesaredeveloped,EPAwillanalyzethedataspecifictothosesourcesanddetermine,undersection112(d),inwhatmannerrequirementswillbeestablished.Someareacategoriesmaybenegligiblecontributorstothe90percentgoal,andassuchposeunwarrantedburdensforsubjectingtostandards.Thesetrivialsourcecategorieswillberemovedfromthelistingastheyareevaluatedsincetheywillnotcontributesignificantlytothe90percentgoal. detailwithinthebaseyearinventorydocument.Anysupportedadditionaldatathathavebeensubmittedbyreviewershavealsobeenincorporated.TheEPAbelievesithassufficientlysupporteditsemissionsestimatesandhasbeenasinclusiveaspossibleofallrelevantdata.TheEPAfurthernotesthatthecommenterhassuppliednoinformationwhichwouldcontradictorrefuteEPAsbeliefthatallsourcecategorieshavebeenidentified. AnothercommenterstateditisnotappropriateforEPAtohaveclaimedsection112(c)(6)creditforsection112(d)(2)applicabilityandMACTemissionreductionswhenthesubjectstandarddoesnotreducenorrequireanyreductionsforthesection112(c)(6)HAP.IfEPAevaluatesthissituationforacategoryanddeterminesthatnorealreductionsarepossibleunderagivenMACT,thecommenterstatedthattheyshouldreportthisfindingtoCongress.Thecommenterfurtherarguedthatclaimingthesecreditsforstandardsthatdonothingintermsofrealemissionreductionsisnotappropriate. Somecommentersemphasizedthepointthatin 0 .-&. whethertheywereorwerenot,areasourceswithinthePortlandcementindustryarenotpresumedtoberegulatedbytheindustryMACTstandardsasaresultoftheirinclusioninthesection112(c)(6)sourcelist. ` Response: TheEPArespondsthatsection112(c)(6)   requiresthatsourcesaccountingforatleast90percentofemissionsofthespecifiedpollutantsbesubjecttosection112(d)(2)standardsorsection112(d)(4).Unlikesection112(c)(3),thisrequirementdoesnotcallfor,nordoesEPAbelieveitpermits,afindingofhealthorenvironmentalthreatfromareasourcestodetermineifsuchsourcesneedtobeincludedtomeetthe90percentrequirement.However,EPAwilldeterminewhetherspecificregulationoftheareasourcecomponentofasourcecategoryisappropriate,ornecessarytomeetthe90percentgoal,basedonmoresourcecategoryspecificdatacollectedaspartoftheregulatoryprocess. asappropriate.TheEPAchosetosplithazardousandnonhazardouswasteburningsourcecategoriesinordertoreflectthedistinctionsmadeinMACTstandardscurrentlyunderdevelopmentwithinEPAsOfficeofAirQualityPlanningandStandards(OAQPS)andtheOfficeofSolidWaste(OSW).TheOAQPSrule,whichisnotyetproposed,appliestocementkilnsthatdonotburnhazardouswasteandtootherHAPemittingsourcesatacementplant,regardlessofwhetherornotthecementkilnburnshazardouswaste.CementkilnsthatburnhazardouswastewillbecoveredbythehazardouswastecombustorrulewhichwasproposedApril19,1996(61FR17358).Approximately40outofthe210cementkilnsintheU.S.burnhazardouswasteasafuel.Thesourcesburninghazardousandnonhazardousfuelarebeingregulatedunderseparateactionsduetotheirdifferentemissionscharacteristics,differentairpollutioncontrols,andseparateclassificationbyvirtueofsection3004(q)oftheResourceConservationandRecoveryAct. ` Comment: SeveralcommentersrespondedtoEPAsrequest $`$ forinputonthemostappropriatedefinitionofPOMforuseinthisaction.Whilemanycommentsprovidedinformationthatwillimprovetheemissionsestimatesforthevarioussourcecategoriesemittingthesecompounds,EPAdidnotreceiveinformationwhichwouldfavortheselectionofone .-&. surrogateapproachoveranotherasabasistomakelistingdeterminationsforallcategoriesassociatedwithemissionsofsection112(c)(6)HAP. ` Response: POMisdefinedinsection112(b)to `   [i]nclude[]organiccompoundswithmorethanonebenzenering,andwhichhaveaboilingpointgreaterthanorequalto100oC.ThecomplexmixtureofPOMconsistsofliterally ~.  thousandsoforganiccompounds,andnostandardizedmethodexistsatthistimetomeasuretheseemissions.Thereare,however,somevalidsurrogatesforPOMthatprovidesufficientemissionsinventorydataforthisanalysis:1)extractableorganicmatter(EOM),whichiscomposedofthesolventextractablefractionofparticulatematter,2)thesumofthesevenpolynucleararomatichydrocarboncompoundsthatareprobablecarcinogens(7PAH),and3)thesumofthesixteenPAHsmeasuredinEPAtestmethod610(16PAH).(ForamorecompletediscussionofPOMsurrogates,refertothesection112(c)(6)emissionsinventorydocument.)TheEPAandothersareengagedinfurthereffortstobettercharacterizetheconstituentsofPOMthataremostsignificantinevaluatinghealthandenvironmentaleffects. Althoughthesection112(c)(6)emissionsinventoryincludesestimatesofemissionsfromcigarettesmoke,EPAdoesnotdeemthistobeasourcecategoryintendedforregulationasastationarysourceundersection112.Section112(a)(3)defines stationarysourcebyreferringtosection111(a),whichprovidesthatastationarysourceis anybuilding,structure,facility,orinstallationwhichemitsormayemitanyairpollutant.Cigarettesmokedoesnotfallwithinthatdefinitionbecauseitisnotemittedbyafixededificesuchasa building,structure,facility,orinstallation.Therefore,thissourcecategorywasexcludedfromtheinventoryofemissionsourcesthatarepotentiallysubjecttostandardsundersection112(c)(6).3.UtilityEmissions P  ` Thelanguageinsection112(c)(6)statesthatthe TheEPAbelievesthatsection112(n)(1)(A)istheappropriateauthorityforevaluatingutilityemissionsanddeterminingthenecessityofregulationforthissourcecategory.Inthedraftsection112(c)(6)listingnotice,EPAproposedtocredittheemissionsofsection112(c)(6)pollutantsfromutilitiesassubjecttostandardsthroughsection112(n)(1)(A).Thisinterpretationwaschallengedbycommenters.Therefore,asdiscussedabove,EPAhasdeterminedittobemoreappropriatetoexcludeutilityemissionsfromthoseconsideredforthesection112(c)(6)analysisandtoaddressthemundersection112(n)(1)(A).4.ConsumerProducts #"  ` Consumerproducts,suchassurfacecoatings,metalcleaningsolvents,personalcareproducts,andhouseholdcleaningproductscontributesignificantlytoemissionsofPOM,asdefinedinthe16polyaromatichydrocarbon(PAH)definition.Theseemissionsarecomposedprimarilyofnaphthalene.Theseemissionscomeprimarilyfromtheuse,  -&. consumption,storage,disposal,destruction,ordecompositionofsuchproducts,andassuch,donotfitthedefinitionof stationarysourceprovidedinsections111(a)(3)and112(a)(3).Theseemissionswerenotquantifiedinthedraftsection112(c)(6)emissionsinventoryordraftlistingFederalRegisternotice.The p  emissionsestimatesarearesultofinventorydevelopmentworkonaconcurrentEPAprojectrelatedtoemissionsinurbanareas(section112(c)(3)and112(k)).TheEPAbelievesitisimportantthattheemissionsfromconsumerproductsbeidentifiedandthepublicinformedoftheirpotentialsignificance.Althoughtheseemissionsaccountforasignificantfractionoftotal16PAHemissions,EPAdoesnotconsiderthemappropriateforregulationundersection112andbelievesinsteadthattheyshouldbeaddressedthroughothermeans. ` Regulationsforconsumerproductshavebeenproposedforcontrolofvolatileorganiccompounds(VOC)pursuanttosection183(e)oftheActandareexpectedtoresultinsignificantreductionsinVOC.NaphthaleneisaVOC.ThisprovisionrequiresEPAtoaccountforsourcesof80percentoftotalVOCemissionsfromconsumerproductsinozonenonattainmentareasandsubjectthesesourcestobestavailablecontrols.  -&.  ` Theproposedrulewouldaffectapproximately220consumerproductmanufacturersandimportersnationwide.ManyofthesecompaniesarealreadytakingstepstoreformulatetheirproductstoemitlessVOC.TheEPAworkedcloselywiththesecompaniesindevelopingtheproposedrule. (gasstations)occurwhenvaporsaredisplacedfromamotorvehiclesfueltankduringtherefuelingprocess.Refuelingaccountsfor374tonsofthe16-PAHemissions(naphthalene)inthe1990baseyearinventory.TheEPArecognizestheimportanceofcontrollingtheseemissionsbutbelievesthattheyarenotappropriatelythesubjectofregulationundersection112. ` Promulgationofasection112standardtocontrolemissionsfromrefuelingwouldfrustrateCongressintenttoregulatethoseemissionsthroughsections182(b)(3)and202(a)(6).Ratherthantreatingrefuelingemissionsinthe  -&. samemannerthattheytreatedotherHAPemissions,Congresselectedtoprovideaspecial,comprehensiveprogramspecificallytailoredtorefueling. ` Thefirststepoftheprogram,insection182(b)(3),setsforthashort-termsolution.Itrequirestheinstallationofcontrolsonfuelpumpstorecoverrefuelingemissions( stageII)andincludesaschedulewhichcallsforpromptcompliancewithitsrequirements.StageIIwasinitiallyrequiredforgasolinedispensingfacilitieswhichsellmorethan10,000gallonsofgasolinepermonth(or50,000gallonspermonth,inthecaseofindependentsmallbusinessmarketers)inallareasthatare moderateorworsenonattainmentareasforozone.Inaddition,section184(b)(2)oftheActrequiresallareasintheozonetransportregion(OTR)toadoptstageIIcontrolsorcontrolmeasurescapableofachievingcomparableemissionsreductions. ` Thesecondstep,insection202(a)(6),mandatestheuseofvehicle-basedvaporrecoverysystemsinallnewlight-dutyvehicles( onboard).Thescheduleprovidedinsection202(a)(6)allowsforalengthiercomplianceprocessthatimposesonboardcontrolsaftertheinstallationofStageII.UponpromulgationofEPAsonboardregulations,thesection182(b)(3)StageIIrequirementsnolonger  -&. appliedto moderateozonenonattainmentareas,althoughStateswerefreetoleavestageIIcontrolsinplace.Forinstance,someStatesconcludedthatstageIIwasnecessaryforthemtomeetreasonablefurtherprogressorattainmentandmaintenancerequirementsundertitleIoftheAct.Moreover,Statesarefreeundersection116oftheActtoapplyStageIIrequirementsmorestringentlythanisfederallyrequired.OnceEPAdeterminesbyrulethatthoseonboardcontrolsareinwidespreadusethroughoutthemotorvehiclefleet,theStageIIcontrolsmaybescaledbackin seriousorworseozonenonattainmentareas,whileareasintheOTRwillremainsubjecttotherequirementsofsection184(b)(2)toapplyStageIIorcomparablemeasures. ` CongressintenttocomprehensivelyaddressrefuelingemissionsfromgasolinedispensingstationsthroughstageIIandonboardrequirementsisclearlyillustratedbythefocusedregulatoryschemeprovidedinthoseprovisions,bytheprolongedanddetaileddebateontheissue,andbytherecognitionthatsections182(b)(3)and202(a)(6)controltoxics.Impositionofasection112standarduponthatuniquearrangementwouldfrustrateCongressintenttocontrolemissionsfromrefuelingthroughthecomprehensiveregulatorystructureanticipatedbysections182(b)(3)and202(a)(6). ` Tobesure,othertypesofemissionsourcesaresubject -'/ toregulationundermorethanoneprovisionoftheAct.Forexample,anindustrialfacilitymayhavebothsection110Stateimplementationplanrequirementsandsection112airtoxicsstandards.Inthosesituations,sourcesbecomesubjecttomultiplerequirementsbecauseCongressconstructedthosepartsoftheActtoallowforoverlappingcoverage.Sections110and112areintendedtoapplybroadlytoawiderangeofsourceswithoutexcludingtheapplicationofothergeneralrequirements.Inthecaseofevaporativelossesfromvehiclerefueling,however,CongressrequiredstageIIandonboardascontrolsspecificallyfocusedonregulatingtheemissionsfromasingletypeofemissionpointaftersignificantandlengthydiscussionandafterrecognizingthatthosecontrolsaccomplishthegoalsofsection112.Theuniquestructureandhistoryofsections182(b)(3)and202(a)(6)indicateCongressintenttostrikeabalancebetweenburdensongasolinestationownersandrefinersandtoachieveauniform,comprehensiveregulatoryapproachtocontrolofrefuelingemissions.Bycontrast,theremainderoftheActcontemplatestheapplicationofmultipleprovisionstosources. ` RecognitionofCongressplantocontrolrefuelingemissionsthroughstageIIandonboard,ratherthanthroughMACT,doesnotaffectthepublichealth.Asmentioned  -&. facilitiesdesignedfortheincinerationofscraptires.Therearenumerousstoragepilesofscraptiresacrossthecountrycreatedthroughlegalandillegalpractices.Thesestoragepilesareoftensetonfirebyarson,accident,ornaturalcauses(lightning).Somestatesandorganizationshavecreatedrulesandguidelinesdesignedtoreduceandeventuallyeliminatethefirethreatposedbystockpiledtires.TheEPAwillconsidertheseeffortsindevelopingasection112(d)(2)standardforthissourcecategory.Theseemissionsinvolveinadvertentandincidentalreleasesofemissionsratherthandischargesasadirectresultofprocessoperations;assuchitisanalogoustotheincidentalbutsignificantreleaseofemissionsthroughprocessleaksorfromsolventladencleaningrags.TheEPAbelievesitcansubjectthesesourcestostandardsinafashionsimilartoitsapproachtoothersourcesfromwhichsignificantemissionscouldresultfromunsafeorineffectiveworkmanagementpractices. Gasolinedistribution,aviationfuel:Thiscategory,consistsofevaporativelossesfromthetransferandstorageofleadedaviationfuel,andaircraftrefuelingandassociatedspillage.Notethattheseemissionsareassociatedwithfuelcontaining_alkylated_Ԁlead,commonlyreferredtoasaviationgas,andusedprimarilyingeneral  -&. _aviationaircraft.Thisisnotthesameascommercialjetfuel.Thissourcecategoryaccountsfor81.3percentofthe1990baseyearinventory.However,sinceleadedgasolinehasbeenbannedforuseinmotorvehiclessincethe1990inventoryestimate,thissourcecategoryaccountsfortheonlyknownremainingemissionsofalkylatedlead.Thuslistingthissourcecategorywillsubject100percentofcurrentalkylatedleademissionstostandards.VI.RegulatoryRequirements
