Participantsexpressedconcernovertheuseoftheword presumptiveinPMACT,andthatdevelopmentofaPMACTemissionlimitationprematurelycouldbemisusedbystateandlocalagencies.Theysuggestusingtheword preliminaryinstead.  ArelatedissueisthetimeframeallottedtothedevelopmentofPMACT.IndustryrepresentativesdonotviewfourmonthsasareasonableamountoftimeforestablishingascientificallysoundPMACT.ItwasstatedthatifthePMACTwillestablishpresumptiveemissionlimitationsitmusthaveasubstantialbasis.Ms.HerringrespondedthatalthoughthePMACTprocessisrequired,settingaPMACTemissionlimitationisnot.TheEPAwillnotissueaPMACTinOctoberifthereisnotsufficientdatatodoso.ThePMACTprocess,however,willendinOctoberasscheduled.  ConcernwasraisedregardingtheuseofcasebycaseMACTversustheprovisionsof112(j)oftheCleanAirActAmendmentof1990(CAAA).EPArespondedthatcasebycaseMACTand112(j)wouldapplytonewsourcesonlyandwouldnotbeusedforexistingsources.DevelopmentofaCTGversusANationalRuleforVOC󀄀Participantsvoicedconcernsabout #! howstateregulationsmaybebaseduponaControlTechniqueGuideline(CTG)developedbyEPAinconjunctionwiththeMACTversustheestablishmentofanationalrule.Manycompanieshavefacilitiesinseveralstates,andhaveconcernsregardingthedifferentrequirementseachfacilityhastomeet;competingcompaniesarenotalwaysonalevelplayingfield.EPAexplainedthatstatesenacttheirownregulationsinadditiontotheFederalstandards.Anationalruledoesnotpreemptstateorlocalregulatoryagenciesfromenactingstricterstandards.PotentialOverlaps󀄀Concernshavebeenraisedinpreviousmeetingsabouttheoverlapofthe -P(+ MMPPcategorywithothercategories(e.g.,plasticparts)whichmayresultindiffering -@), requirementsfromprocessescoatingdifferentproductsbutusingidenticalcoatingmaterials.TheEPAbelievesthatbydevelopingthevarioussurfacecoatingcategoriesconcurrentlythisoverlapwillbeaddressedmoredirectly.ItwasalsonotedthattheexistingCTGforMMPPcoveredthingsnotspecificallycoveredbyotherrules.TheEPAstatedthatitdoesnotwanttoburdenindustry,andisworkingtoavoidtheproblemofoverlappingstandards.Terminology󀄀BruceMoore,EPATeamLeaderfortheMiscellaneousMetalPartsandProducts P  project,clarifiedsomeofthecommonlyusedterminologyforstakeholders. WorkgroupisdefinedastheregulatoryteamofEPAofficerepresentativesinvolvedintheMiscellaneousMetalPartsandProductssourcecategory,andthoseregulatoryagencyrepresentativesthatactivelydeveloptheproposedstandards.Theterm subgroupwillapplytosubsetsofthestakeholdersgroupwithcommoninterestsororganizedtomoreeffectivelyexplorespecificissues.Subgroupswillnotnecessarilybecomesubcategoriestothesourcecategory.MACTFloorIssues󀄀GeorgeWoodall,ofPacificEnvironmentalServices,Inc.(PES),discussed  someoftheissuesthatwillbefacedindeterminingtheMACTfloor.Participantswereconcernedastohowthetop12%offacilitieswillbeestablished.Thedefinitionof majorsourceisdifferentforHAPsandVOCsandquestionsastohowthiswouldaffectaMACTfloordeterminationwereraised.TherewerealsoquestionsastowhichdatawillbeusedinMACTfloordeterminations,theactualemissionratesorthepermittedemissionlimitations.TherewasfurtherconcernaboutfacilitieswhichhavelowemissionsduetopollutionpreventionoruseofcostlyaddoncontrolsandmaynotbeconsideredasmajorsourcesunderTitleVandwouldtherebybemissedinananalysisofstrictlymajorsources.ProgresstoDate󀄀Dr.WoodallpresentedasynopsisoftheprogresstodateontheMMPP ` project.Severalmeetingswithsubgroupshavetakenplacetodiscusscoatingoperationsincertainindustriesandtovoiceotherconcerns.MeetingswiththeTruckManufacturersAssociation,theAluminumExtrudersCouncil,magnetwirecoaters,anautomotiveassociation,andregulatoryandsmallbusinessstakeholderstookplace.Thesummariesfromthosemeetingswereprovidedwiththekickoffmeetingmaterials.  TheprojectteamsforbothMMPPandtheplasticpartssourcecategorieshavealsovisitedtheVolvofacilityinDublin,VirginiaandtheFreightlinerfacilitiesinClevelandandMountHolly,NorthCarolina.Additionalsitevisitsarebeingplannedforothertypesoffacilities,includingamagnetwirecoatinglineandarailcarfacility.  ParticipantsdiscussedtheprocessofidentifyingfacilitiesthatwillbesubjecttotheMACTstandards.TheEPAisusingtheAIRSandTRIdatabasestoobtaininformationaboutfacilities.FacilitieswillbetentativelyidentifiedthroughAIRS,thencrossreferencedwithTRItoobtainHAPemissionsinformation(theAIRSdatabasedoesnotstoreHAPemissionsdata).Thisapproachwillprovidearoughsketchoftheindustry.ConcernwasraisedovertheAIRSinformationbeingoutdated.TheStateofFloridahasdevelopeditsowndatabasewhichismoreuptodate,andthesefindingswereofferedforanalysis.TheEPAwillalsobesendingaletterto thestatesrequestinginformationonapplicablefacilities. -P(+   Aregulatoryreviewhasbeenrenderedtoprovidecomparisonofthesurfacecoating regulationsbetweenstatesandasummarytablefromthatreviewwasalsoincludedinthemeetingmaterials.TheEPAisalsoworkingonacomprehensivesetofdefinitionsthatwouldapplytoalleightsurfacecoatingcategories.Thesedefinitionsarebeingdraftedfromstateregulations,CTGdocuments,andothersources.  Twosetsofquestionnairesarecurrentlybeingdeveloped:oneforusewithsitevisits,andanotherthatwillbesentunderSection114authorityasanalternativetothegenericICRalreadyapprovedbyOMB.ThissecondquestionnairewillbedevelopedinlaterstakeholdermeetingsfordispersalsometimeaftertheendofOctober.  Participantsinitiatedadiscussionaboutthesubcategorizationissue.TheEPAhasnotrecognizedanygroupsassubcategoriestodate,thesubgroupsthathavebeenidentifiedarestakeholdersandassociationsthathaveapproachedtheEPAwiththeirspecialconcerns.Participantsstatedthattherearenumerousothergroupsthatcouldhaveaninterestandshouldbecontacted.EPAstatedthatanyinquiriesregardingadditionalsubgroupsarewelcome.ActivitiesthroughtheNextMeeting󀄀InadditiontothegenericInformationCollectionRequest  (ICR)thatwillbesentoutunderSection114,theEPAwillalsobedevelopinganalternativequestionnairethatistailoredtospecificindustrycategories.Facilitieswillhavetheoptionofchoosingwhichquestionnairetoanswer.CopiesofthegenericICRwereincludedintheAprilWorkshopnotebook.Roughdraftsofthealternativequestionnairewillbesentoutforreviewbyindustrybeforethenextmeeting.FinJohnson,oftheNCSmallBusinessOmbudsmanOffice,statedthatmanystateshaveconductedinventoriesofHAPsandsuggestedthepossibilitythatfacilitiesmaysubmittheseinsteadofcompletingthequestionnaire,therebyreducingreportingburdensonsmallerfacilities.  Participantsdiscussedthetargetdatesforsubsequentmeetings.ThenextmeetingwillbeheldduringthefirstweekinAugustinconjunctionwiththePlasticPartsStakeholdersgroupattheEPAEnvironmentalResearchCenterBuildinginResearchTrianglePark,NC.AdditionalmeetingsweretentativelyscheduledformidSeptemberandtheendofOctober.Furtherdetailswillbeannouncedinafewweeks.IssuesSubgroups󀄀Duringthediscussionsthattookplaceduringthemorningsessionofthe ! meeting,issueswerenotedforfurtherdiscussion.Attheendofthemorningsession,theseissueswereconsolidatedintoalistofsixmainissuesthatservedastheagendafortheafternoonsession.Participantswereaskedtoidentifyissuesinwhichtheywereinterestedandformissuessubgroupsthatwouldreportbackatthenextstakeholdersmeeting. SourceSize󀄀ThisIssueSubgroupwilllookatmajorsourcefacilitiesversusmajorsource    processes;minorsourcefacilitiesversusmajorprocesses;otheragencyareasource  programsandstrategies;andtheinclusionofsmallbusiness.  DataCollection󀄀Oneofthemainissuesofdatacollectionisdeterminationofthe @    baselineyear.Participantsquestionedwhetherthebaselinewouldbesetforthe  0    wholecategory,bysubcategory,orbyfacility.Therewasdiscussionregardingthe  inclusionofprioremissionreductionswhenchoosingthebaseline.Itwasstated  `    thattheAerospaceMACTallowedforsomefacilitybasedregulation.Theissue  P    ofactualversuspermittedemissionrateswillbeanalyzedduringthereviewof  @    TitleV/Installationpermits,permitsbyrule,emissionlimitations,andothers.  0    AlthoughallstatesdonotcurrentlyhaveTitleVpermitprogramsinplace,      theyshouldbeforethisruleispromulgated.However,itwasstatedthatmany     facilitieshavepermittedemissionsthatarewellabovetheiractualemission     rates.Itwasrecommendedthatthereshouldbedistinguishmentbetweenactual     emissionratesandpermittedemissionslimitationswhenthisdataisanalyzed.     Theissueraisedearlierastohowthetop12%oftheindustrywillbedefinedwas     alsodiscussedfurther. Thedocumentationforeachcategorymight,ormightnot,containapreliminaryemissionlimitation/controlstrategyforPMACT.PMACTwillbeincludedifthereisgeneralagreementamongtheEPAandstakeholderrepresentativesthatitisanappropriateresourcetomakeavailableforcasebycaseMACTdeterminationsandthatthereisadequatetechnicalsupportforit.However,asthenameimplies( presumptiveMACT),PMACTisnotnecessarilyMACTandisnotexpectedtohavethesamelevelofsupportingdataandinformationasMACT.  Forthecoatingcategories,PMACTdeterminationswillnotbeattemptedforexistingsourcesorforsegmentsoftheindustrythatmayrequiremoreextensivestudyandinvestigationthanotherstoestablishPMACT,suchasthosethattraditionallyhavenotbeenincludedinthesourcecategories.Thefirstphasedocumentationwillsummarizetheknowledgegainedabouttheseindustrysegmentsandtheadditionalinformationthatwillbeneededbeforeanyrecommendationsconcerningemissioncontrolrequirementscanbemade.Itwillalsosummarizeinformationonexistingsourcesanddiscussuniquechallengestheymayhaveincontrollingemissionsthatmaynotapplytonewsources(i.e.,retrofitconsiderations).  -P(+   Oncethisfirstphaseoftheregulatorydevelopmentprocessiscompleted,EPA willcontinuetobuildontheknowledgegainedandproceedwithmorefocusedinvestigationanddataanalysis.Wehopethatmostofthedatagatheringwillbecompletedbytheendof1998sothatMACTfloorsandregulatoryoptionscanbedeterminedandanalysisofimpactsconductedinearly1999.Atthatpoint,decisionswillbemadeontheformandcontentoftheproposedregulations,andtheregulatorypackageswillbepreparedformanagementreviewsandapprovals.Theprojecteddateforproposaloftherulesisbytheendof1999withpromulgationbytheendof2000.
