Webelievesuchawaivershouldbegrantedinthelimitedcircumstanceswhenashipisclassifiedasbeinginoperational# 7U^XXdXXd7  #" 7U^XXdXXd7   7U^XXdXXd7   7U^XXdXXd7   7U^XXdXXd7  "! 7U^XXdXXd7   7U^XXdXXd7   7U^XXdXXd7   7U^XXdXXd7  !status,andmaintenancepaintingisbeingconductedatthattime. -(0  7XXdXXd7  Pursuantto40CFR63.10(f),suchawaivermaybegrantedbythe d Administratorif,intheAdministratorsjudgement,theaffectedsourceisachievingtherelevantstandard.Asyouknow,theauthoritytograntsuchwaivershasbeendelegatedtotheRegionalAdministrators(SEEattachedDelegation7124).Therefore,weofferthefollowingbackgroundinformationandguidancetoassisttheRegionsinrespondingtowaiverrequestsfromtheNavyregardingthisissue.Background/Guidance  t    Pursuantto40CFR63.788(b)(3)(i),therecordsmaintainedbyfacilitiesdemonstratingcompliance(usingtheproceduresdescribedintheNESHAP,40CFR63.785)mustcontain:(A)Certificationoftheasappliedvolatileorganiccompounds(VOC)contentofeachbatchofcoating;and(B)Thevolumeofeachcoatingapplied.Henceallaffectedsourcesmustmaintain(A)and(B)aboveforallcrewpaintingthatoccursonallnavalshipsinoperationalstatusenteringandexitingthoseaffectedsourcesinaregularfashionaccordingtodeploymentortrainingschedules.TheNavyhasrequestedawaiverfromthisrequirement.TheNavycontendsthatthisrequirementwouldbeoverlyburdensomeinsituationswherepaintingisbeingconductedasanancillaryactivitywhiletheshipisinoperationalstatusandisberthedatanavalstationthatisanaffectedsourceunderthisNESHAP.TheNavyfurthercontendsthatthereisnoenvironmentalbenefittomaintainingrecordsandsubmittingreportsastheNavyusesonlyVOCcompliantpaintandhasimplementedanothinningpolicy.  BasedonourdiscussionwiththeNavyandtheinformationwereceivedfromthem,weagreethatrecordkeepingforcrewpaintingofvesselsinoperationalstatuswouldrequireasignificantincreaseintimewithnoincreaseinenvironmentalbenefit.Itwouldbeextremelydifficultforashorefacilitymanagertoaccountforthevolumeofpaintusedbyeverycrewoneveryshipinoperationalstatuswhichentersorexitsthefacility.Moreimportantly,wefeelthisdetailedaccountingofcrewpaintingisunnecessaryinmeetingtheNESHAPrequirementssincetheNavyfollowstwoessentialpolicies:(1)theNavyusesVOCcompliantpaint;and(2)a nothinningpolicyisineffectNavywideforcrewpainting.  #XU^XX Xjs# XjXXXU^Withrespecttothefirstpolicy,#XU^XX Xjs# XjXXXU^Ԁinitssolicitationsfor *#+ theNavy,theGeneralServicesAdministration(GSA)requires(since1994)marinecoatingsthatmeetorexceedtheNESHAPVOCcontentstandards.T#XU^XX Xj# XjXXXU^heNavyssupplyprocessensuresthatonly |,&. compliantcoatingsareacquiredattheNavyFleetIndustrial P-&/ SupplyCenter(FISC)level,and,therefore,onlycompliantcoatingsareissuedtotheships(SEEtheattachedflowchart,NAVYMARINECOATINGCERTIFICATIONDOCUMENTATIONPROCESS).     TomeetthecertificationrequirementsoftheNESHAPtheNavyhasofficiallyrequestedassistancefromtheGSAincentrallycertifyingthemarinecoatingstheyprocurefortheNavy.TheGSAhasmodifieditssolicitationsformarinecoatingstorequirethatcertificationdocumentationconsistentwiththeNESHAP,andinaccordancewiththeJanuary7,1998letterfromJohnB.RasnicoftheEPAsOfficeofCompliancetoJimSelloftheNationalPaintandCoatingsAssociation#XU^XX Xj# XjXXXU^(SEEattached (  letter),#XU^XX Xjj# XjXXXU^beprovidedforeachformulationofcoatingpriorto `  awardofacontract.#XU^XX Xj# XjXXXU^  Wheninreceiptofthiscertificationdocumentationfromthemanufacturers,theGSAwillforwardthedocumentationtotheNavalSupplySystemsCommand(NAVSUP).Forthepurposesofensuringcomplianceatthefacilitylevel,#XU^XX Xjx# XjXXXU^ԀNAVSUPhasestablished X adatabaseofmarinecoatingcertificationsandwilldistributethisonamonthlybasistotheFISCs,majorcommandsthatmanageNESHAPaffectedsources,anddirectlytoaffectedsources.Ateachpointinthesupplychain(GSA,NAVSUP,FISC,andNavyendusers(shoreactivitiesandship'sforce))),canobtaindatabaseinformationoncertifiedcoatingsprocuredthroughGSAandcanverifythatmarinecoatingsinstoragearecertifiedasNESHAPcompliant.
