To ensure full public participation as EPA determines how and when to transition from the 1-hour ozone standard to the 8-hour standard, the Environmental Protection Agency (EPA) on Dec. 19, 2002, proposed to keep stay its authority to determine that the 1-hour standard no longer applies in areas meeting that standard.
The proposed stay would remain effective until such time as the Agency takes final action in a subsequent rulemaking.
Today's action is in response to a negotiated settlement agreement between EPA and the Environmental Defense and Appalachian Mountain Club. The litigants agreed to dismiss their cases against EPA if today's action occurs and
