Abstract:
The Direct Final Rule amends the control device requirements of 40 CFR 60.18 and 40 CFR 63.11, permitting the use of hydrogen-fueled flares. These amendments add specifications for hydrogen-fueled flares that will achieve the same control efficiency (i.e., 98 percent or greater) as flares complying with the existing flare specifications. The amendments are also being issued as a proposed rule in the proposed rules section of the FEDERAL REGISTER. The amendatory rule language appears in association with the Direct Final Rule and is cross-referenced, but not repeated, in the proposed rule preamble. If no significant adverse comments are received on the proposed rule by the due date for comments, no further action will be taken with respect to the proposed rule, and the direct final rule will become final on the date provided in that action.
