Abstract:
This fact sheet describes the Clarifications to Existing NESHAP Delegations' Provisions rulemaking. The rule clarifies which parts or authorities (such as approval or disapproval of an alternative reporting schedule) of the existing NESHAP can be delegated to State, local, and tribal air pollution control agencies (S/L/Ts) by adding or modifying a section in each NESHAP to describe the authorities that can be delegated and those that must be retained by EPA. The S/L/Ts may not exercise these authorities unless the NESHAP has been delegated to them. In addition, to further clarify which portions of the NESHAP are delegable, some NESHAP standards sections were slightly reorganized or rephrased to separate delegable from non-delegable authorities. These clarifications do not change any substantive NESHAP requirements for industrial sources.
