| Abstract: On January 12, 2001, EPA issued a direct final rule amending its 1997 Compliance Assurance Monitoring rule to revise compliance certification requirements. EPA issued the amendments in response to a U.S. Circuit Court of Appeals decision that remanded a portion of the Compliance Assurance Monitoring rule. In particular, the Court ruled source owners submitting a compliance certification must address whether the affected facility or source has been in continuous or intermittent compliance. The Jan. 12, 2001 action applies only to the compliance certification requirements. EPA published this notice as a direct final rule with a concurrent proposal that will be withdrawn if the Agency receives no adverse comments. |
