RESPONSE TO PUBLIC COMMENTS ON THE CONDITIONALLY EXEMPT SMALL QUANTITY GENERATOR WASTE MANAGEMENT PROPOSAL June 17, 1995 U.S. Environmental Protection Agency Office of Solid Waste, OSW (renamed Office of Resource Conservation and Recovery, ORCR, on January 18, 2009) EPA Docket Number F-95-NCEP FFFFF INTRODUCTION This document provides EPA's responses to comments received on the Criteria for Classification of Solid Waste Disposal Facilities and Practices; Identification and Listing of Hazardous Waste; Requirements for Authorization of State Hazardous Waste Programs Proposed Rule (60 FR 30964-30992, June 12, 1995). The public comments are available in the docket for the proposed rule (docket number F-95-NCEP FFFFF). The proposed rule contained changes and additions to the existing Criteria for solid waste disposal facilities and practices. The proposal established specific standards for non-municipal solid waste disposal facilities that receive conditionally exempt small quantity generator (CESQG) wastes. The rule also proposed revisions to regulations for hazardous waste generated by CESQG's. The proposal clarified acceptable disposal options under Subtitle D of the Resource Conservation and Recovery Act (RCRA) by specifying that CESQG hazardous waste may be managed at municipal landfills subject to Part 258 and at non-municipal solid waste facilities subject to the facility standards in the proposed rule. Appendix I provides an alphabetical listing of the commenters on the proposed rule.
