Direct Final Rule

We published a direct final rule to correct the final Effluent Limitations Guidelines, Pretreatment Standards, and New Source Performance Standards for the Transportation Equipment Cleaning Point Source Industry Category. This correction fixes a typographical error in the final rule.

Background

Transportation equipment cleaning (TEC) facilities generate wastewater from cleaning the interior of tank trucks, closed-top hopper trucks, rail tank cars, closed-top hopper rail cars, intermodal tank containers, inland tank barges, closed-top hopper barges, ocean/sea tankers, and other similar tanks (excluding drums and intermediate bulk containers) used to transport materials or cargos that come into direct contact with the tank or container interior.

About this Correction

On August 14, 2000 (65 FR 49666), we published in the Federal Register final effluent limitations and standards for the transportation equipment cleaning point source category. The final rule contained a typographical error. This error consisted of using the word "existing" instead of "new" under 40 CFR 442.16(b), which contains pretreatment standards for new sources (PSNS). This action corrects this typographical error.

We are correcting this typographical error through a direct final rulemaking. We are publishing this rule without prior proposal because we view this as a noncontroversial correction and anticipate no adverse comment. We are not substantively altering the final rule or expanding the regulatory burden through correction of this minor error. However, we are publishing a separate document that will serve as the proposal to revise the Transportation Equipment Cleaning Effluent Limitations Guidelines if adverse comments are filed.
