Summary

Failure to fully comply with Oil Pollution Prevention regulations at 40 C.F.R. Part 112 in violation of Section 311(j) of the Clean Water Act, 33 U.S.C. § 1321, by failing to have fully and adequately prepared and implemented a Spill Prevention Control and Countermeasure (SPCC) plan for the facility, including not having sufficiently impervious secondary containment for the 1.18 million gallon oil storage tank or sufficient containment for the loading racks due to a damaged berm. The public comment period will be open from November 9, 2015 to December 8, 2015.
