The U.S. Environmental Protection Agency (EPA) is seeking individual input on Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) enforcement concerns regarding per- and polyfluoroalkyl substances (PFAS) contamination through two public listening sessions, scheduled for March 14 and 23, 2023. Please use this form to submit any written input on CERCLA PFAS enforcement. In addition, there is opportunity to offer verbal input in the public listening sessions.

To the extent that PFAS cleanup enforcement efforts occur under the authority of CERCLA, EPA will develop a CERCLA enforcement discretion and settlement policy. The verbal and written input received will be reviewed and considered by EPA in drafting a CERCLA PFAS enforcement discretion and settlement policy.
These CERCLA PFAS Enforcement Listening Sessions are separate from EPA’s rulemaking process to designate perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS) as CERCLA hazardous substances. The written remarks you provide here are not part of the PFOA/PFOS rulemaking comment docket. The hazardous substance designation rulemaking comment period has closed.
