Legal Notice - Statement of Basis Issued for Proposed Remedy and Public Availability Session Announced
The U.S. Environmental Protection Agency (EPA) Region 7, 11201 Renner Boulevard, Lenexa, KS 66219, is providing public notice regarding issuance of a Statement of Basis for a Proposed Remedy for the Occidental Chemical Corporation, Inc. Facility, 6200 South Ridge Road, Wichita, KS 67215 (EPA ID# KSD007482029).
EPA is issuing a Statement of Basis for a Proposed Remedy for the Occidental Chemical Corporation, Inc. facility site. This facility is required under the existing permit to investigate and remediate contamination resulting from releases at the facility.
The Proposed Remedy entails continued operation of the existing groundwater interceptor well system with groundwater plume monitoring, and the addition of one extraction well; maintaining ground cover with inspection and maintenance; limited excavation of surface soil and consolidation within the existing landfill, plus installation of a seep collection system to enhance the landfill cap; continued operation plus inspection and maintenance to protect against vapor intrusion; installation of recovery wells for contaminant removal; activity and use limitations to prevent human contact usage of impacted groundwater; limiting future site use to commercial or industrial; and requiring a media management plan to prevent exposures during future excavations on-site.

The public comment period begins June 26, 2018, and ends August 9, 2018. Comments must be submitted in writing to:

A formal public hearing on the Remedy Proposal and draft Permit Modification has not been scheduled. However, if requests are received that indicate significant public interest in the Statement of Basis for the Proposed Remedy, a public hearing can be scheduled. Requests for a public hearing must be made in writing to Brad Roberts at the address listed above, and must state the nature of issues to be raised. Such requests must be submitted prior to August 9, 2018.
After consideration of all comments received, and of the requirements of the Resource Conservation and Recovery Act (RCRA), EPA will make a Final Decision. If the decision is made to select a Final Remedy that is substantially unchanged from that described in the Statement of Basis made available for public comment as announced by this notice, EPA will notify all persons submitting comments or requesting a notice of the Final Decision. If the selected remedy is substantially changed from that described in the Statement of Basis, EPA will issue a public notice indicating the changes.
