Public Notice: City of Phoenix 91st Avenue Wastewater Treatment Plant; Reissuance of NPDES Permit AZ0020524
EPA is issuing a notice of proposed action under the Clean Water Act to reissue a National Pollutant Discharge Elimination System (NPDES) permit AZ0020524 to: City Of Phoenix 91st Avenue Wastewater Treatment Plant, 5615 South 91st Avenue, Tolleson, Arizona 85353. Mailing Address: 2474 South 22nd Avenue -Bldg. 31, Phoenix, Arizona 85009.
The City of Phoenix 91st Avenue Wastewater Treatment Plant (The COP 91st Ave. WWTP or WWTP) provides wastewater treatment services for the City of Phoenix and Sub-Regional Operating Group (SROG) member cites of Glendale, Mesa, Phoenix, Scottsdale, and Tempe, in Maricopa County Arizona serving a population of approximately 2.6 million. EPA is reissuing the permit because the jurisdictional status of the two permitted outfalls continues to be disputed between Arizona and The Gila River Indian Community (GRIC).
The COP 91st Ave. WWTP has a design flow of 230 MGD. Currently, the plant processes an average of about 134 MGD of influent from its collection system. About 61 MGD on average, is sent to the Palo Verde Nuclear Generating Station (“PVNGS”) for reuse. The rest of the effluent flows to the Salt River from the Tres Rios Flow Regulating Wetland (“FRW”) via Outfall 005. The permit also authorizes the discharge directly into the Salt River for emergency situations via Outfall 001. Biosolids generated from the facility are removed by a contract hauler to local farms for agricultural land application and/or disposal. The permittee is classified as a major discharger.
EPA is also soliciting comments regarding issuance of a Clean Water Act (CWA) §401 water quality certification for this permit. Under CWA §401, a federal agency may not issue a permit that may result in any discharge into waters of the United States unless a state or authorized tribe where the discharge would originate issues a §401 certification verifying compliance with existing water quality requirements or waives the certification requirement. For permits on tribal lands, if a tribe does not have authority to issue a §401 certification, EPA makes the determination regarding the §401 certification.
