Public Notice: Consent Agreement and Final Order for Bluegrass Contracting Corporation, Brooks Hill Road, Brooks, Kentucky 40109
The U.S. Environmental Protection Agency (EPA), Region 4, located at 61 Forsyth Street, Atlanta, Georgia, 30303, proposes to issue a Consent Agreement and Final Order (CAFO), Docket No. CWA-04-2021-0506(b), that assesses an administrative penalty of $76,000.00 to Bluegrass Contracting Corporation, (Respondent) under the authority of Section 309(g)(2)(B) of the Clean Water Act (CWA), 33 U.S.C. § 1319(g)(2)(B). The CAFO will settle EPA’s allegations that the Respondent made unauthorized discharges of dredged and/or fill material into waters of the United States at construction waste disposal site located off of Brooks Hill Road near Brooks, Kentucky, 40109, at latitude 38.060098º N and longitude -85.738917º, in violation of Section 301 of the Clean Water Act, 33 U.S.C. § 1311. The Respondent’s unauthorized activity impacted approximately 9,083 linear feet of an unnamed intermittent tributary of Bluelick Creek and approximately 41 linear feet of Bluelick Creek. Bluelick Creek is a perennial tributary of Floyds Fork. Floyds Fork flows approximately 3.2 miles to the Salt River, a traditionally navigable water of the United States.
