On March 1, 2017, the U.S. Environmental Protection Agency, Region III (EPA) issued a public notice requesting comments on the proposed renewal of two Underground Injection Control (UIC) Class II-D permits (VAS2D937BDIC and VAS2D947BDIC) to EnerVest Operating, LLC (EnerVest) for disposal of fluids from their company’s oil and gas operations. The injection wells are located in the Nora, Oakwood, and Haysi Fields in Dickenson County, Virginia.
During the public comment period, which ended on March 31, 2017, the permittee submitted comments related to the specific gravity of the disposed fluid. In response to these comments EPA has modified the maximum allowable specific gravity and maximum injection pressure allowed under both permits, and has deleted the requirement to monitor the specific gravity of every truckload. Pursuant 40 C.F.R. 124.14(b), the Region is reopening the public comment period on the modified terms of these draft permits. The Region requests public comment on the modifications regarding the threshold specific gravity, the recalculated maximum injection pressures and the deletion of the requirement to test the specific gravity of every truckload. The reopening of the public comment period is limited to those modifications.
The Region has supplemented the record to clarify and to provide additional evidence to support its findings. These actions are being taken pursuant to the Federal UIC regulations at 40 C.F.R. Parts 124, 144, 146, and 147.
