Public Notice: Hearing and Public Comment Period on Michigan UIC Class II Program Primacy Application

Summary

The U.S. Environmental Protection Agency provides notice that it has received a complete application from the State of Michigan requesting approval of its Underground Injection Control (UIC) Program for Class II injection wells. EPA has determined the application contains all the required elements. Federal authorization of Michigan’s UIC Class II program would allow the Department of Environment, Great Lakes, and Energy to issue permits for Class II injection wells and enforce UIC program requirements in Michigan, except for wells within Indian lands (primarily federally- recognized tribal reservation boundaries). EPA is requesting comments on the application prior to making a decision to approve or disapprove the application.

The comment period ends at midnight June 5, 2020. Submit comments identified by Agency Docket ID No. EPA-R05-OW-2019-0705, in writing or online.

Public Hearing Update

In agreement with Governor Whitmer’s “Stay Home, Stay Safe” order requiring social distancing, EPA will hold the May 27 public hearing as a teleconference. An in-person hearing will not take place.

The virtual public hearing is scheduled in two sessions on  Wednesday, May 27, 2020

There is no need to register in advance for the virtual hearing. You may call 15 minutes in advance of the start time or any time during the session to listen to the hearing. During the hearing, callers will receive instructions on how to join the queue to make a comment.  EPA will start each session with a brief statement.  The operator will call on people to deliver their oral comments. The virtual hearing is an audio-only teleconference. Participants who want to supply written or printed materials, should do so to the online docket or via mail.

EPA will respond to all significant comments on the application after the comment period closes. EPA response will be available online at regulations.gov. You may see a copy of the Michigan Class II UIC Program application online and at:
