The Clean Water Act established the National Pollutant Discharge Elimination System (NPDES) permit program. The NPDES permit program requires permits for storm water discharges from industrial activities, including quarries.
Headquartered in Roanoke, Virginia, Rockydale Quarries Corporation (Rockydale) provides a wide variety of aggregates, agricultural lime, and bio-mix soils to serve the needs of many industries, including construction, agricultural and residential.
On April 8, 2014, EPA inspected the Rockydale - Charlottesville quarry. The EPA Inspection Team obtained and reviewed documentation and other supporting evidence regarding compliance with the permit and implementation of the permittee's Storm Water Management Plan (SWPPP). On February 9, 2016, EPA sent a 308 Information Requirement Letter to Rockydale Quarries asking for information on the other eight facilities that Rockydale owns and operates that engage in excavation of minerals. This settlement addresses deficiencies identified during the April 8, 2014 inspection and during review of Rockydale’s response to the 308 Information Requirement Letter.
The proposed settlement attached to this Public Notice addresses the violations EPA has identified. The EPA Mid-Atlantic Region alleges that Rockydale violated its NPDES permits at six of its quarries in the following manner:
1.Failure to comply with permit requirements concerning retention of records;
2.Failure to comply with permit requirements concerning Comprehensive Site Compliance Evaluations; and
3.Failure to comply with permit requirements concerning the reporting of monitoring results.
Rockydale has agreed to pay a $26,700 penalty, perform and submit to EPA annual Self-Audits for its quarries and to add a Public Information Web Page to their corporate website, identifying Rockydale efforts to comply with NPDES requirements at its quarries.
