Economic Analysis for the Final Rule: Definition of "Waters of the United States" - Recodification of Pre-Existing Rules
On November 18, 2021, the U.S. Environmental Protection Agency and the Department of the Army (“the agencies”) announced the signing of a proposed rule to revise the definition of “waters of the United States.” This proposal marks a key milestone in the regulatory process announced in June, 2021. In accordance with Executive Order 12866, Executive Order 13563, Office of Management and Budget (OMB) Circular A-4, and the EPA’s “Guidelines for Preparing Economic Analyses,” the U.S. Environmental Protection Agency and the U.S. Department of the Army prepared this economic analysis for the final rule, "Definition of 'Waters of the United States' – Recodification of Pre-Existing Rules."
