Treatment as a State Under the Clean Air Act

Pursuant to Section 301(d) of the Clean Air Act (Act), the U.S. Environmental Protection Agency makes determinations of eligibility for the tribe to receive 'Treatment as a State' (TAS) in the implementation of certain elements of the Clean Air Act.  When a Tribe desires to receive TAS for specific elements of the Clean Air Act, they must make application, EPA must review, the public may comment, and ultimately the EPA may grant the request made by the Tribe.  This page lists the TAS CAA actions and associated documents  for Tribes requesting or that have requested such designation in Region 6.
