Revised Enbridge Consent Decree
On January 19, 2017, the United States filed a motion asking the Court to approve the revised settlement in the Enbridge oil spill case.
On May 23, 2017 the Court entered the revised Consent Decree which resolves claims against Enbridge relating to two oil spills that occurred in 2010:
- the July 2010 oil discharge (at least 20,082 barrels) near Marshall, Mich.
- and the September 2010 oil discharge (approximately 6,427 barrels) near Romeoville, Ill.
The original proposed Consent Decree was lodged with the Court on July 20, 2016.
Thereafter, the United States requested public comment on the proposed settlement. In all, the United States received over 17,000 comments on the proposed Consent Decree. The motion to enter included its memorandum in support of the motion, the public comments received (Ex. 1, Parts 1-3), the United States’ response to comments (Ex. 2), the revised Consent Decree (Ex. 3) and a redline/strikeout version of the revised sections of the Consent Decree (Ex. 4).
