Venezia elected to perform an investigation under the U.S. Environmental Protection Agency (EPA)/Pennsylvania Department of Environmental Protection Agency (PADEP) One Cleanup Program Memorandum of Agreement (MOA) which allows facilities who voluntarily enter the Pennsylvania Land Recycling and Environmental Remediation Standards Act (Act 2) to simultaneously satisfy outstanding Corrective Action concerns. The investigation was completed and Venezia submitted an Act 2 Remedial Investigation/Final Report in March 2011, that demonstrated remediation of Volatile Organic Compounds in the subsurface from operation of the former lagoons to a Site Specific Standard (SSS).  Based on this information, EPA selected compliance with and maintenance of institutional controls as the Final Remedy for the Venezia, Inc. this facility located in Nazareth, Pennsylvania (the Facility) on  August 17, 2012.  This is based on the findings as detailed in the Statement of Basis.
   
Because the Facility met SSS for migration to groundwater from contaminated soils related to the former lagoons, the final decision relies upon compliance with and maintenance of activity and use limitations as described in the Environmental Covenant that prohibit use of onsite groundwater for potable purposes and requires notification to PADEP regarding any transfer or change in use of the property if it will affect the contamination on the property.

On February 16, 2021, the EPA conducted a Long Term Stewardship assessment to assess whether the remedy was implemented and protective of human health and the environment. EPA determined that the remedy institutional and engineering controls have been fully implemented and no control deficiencies were identified.

The Facility consists of approximately 10 acres located on Route 248 in Lower Nazareth Township, Northampton County, Pennsylvania. The eastern, southern, and western portions of the Facility are bordered by agricultural land.  The Essroc Cement Company quarry is located to the North.  The Facility has been used for industrial operations since approximately 1960.  The Facility is now owned and operated by Venezia Hauling which purchased the facility on December 28, 2006.  There are two buildings located on site.  One building is occupied by Venezia and used as a maintenance and refueling facility.  The other larger building is identified as a terminal and is rented as warehouse space.

Venezia purchased the Facility from Quality Carriers on December 28, 2006. Venezia is a hauler of cement and concrete dust and operates as a transporter of this non-hazardous commodity. The Facility is used for trailer storage and as a maintenance shop for Venezia’s solid tanker fleet.


Contaminants at this Facility

Benzene, Carbon Tetrachloride, Trichloroethylene (TCE), and cis-1,2-Dichloroethylene (DCE) slightly exceed PADEP’s soil-to-groundwater Statewide Health Standards; limited to the area beneath the former lagoons.  The risk is an ingestion exposure from a possible leaching of soil contaminants into the groundwater. This risk is mitigated by the groundwater use restriction.

Benzene, Carbon Tetrachloride, Chloroform, TCE, and DCE are above USEPA-PA default soil screening levels for protection of indoor air for industrial settings. The risk is an inhalation exposure in possible future indoor buildings from elevated contaminant concentrations in soil. This risk is mitigated by the land use change notification requirement.


Institutional and Engineering Controls at this Facility

[The Institutional Controls  prohibits the use of onsite groundwater for potable purposes and requires the owner and each subsequent owner to submit to the PADEP written documentation regarding the transfer of the Facility, changes in use of the Facility, or filing of applications for building permits for the Facility and any proposals for any site work if it will affect the contamination at the Facility.
